I just don’t know what to make of it. On one hand, nascar is their own worst enemy at times. On the other hand, it’s really bad when 2 teams are on an island against the empire.

IMO NASCAR will ultimately blink because they don’t want MJ’s lawyer … who’s as good as they come, he’s the lawyer in the case that got NIL in college sports … to get a look at their financial records.

NASCAR wants to allow the France family to own a race team in the cup series.

He’s talented. But man is Toyota really dropping the ball with Corey Heim. Heim is the most cup ready talent out there (aside from maybe Shane van Gisbergen). And somehow they’re letting a guy sit in trucks because of a feud with little Gibbs?

This guys gets it. Some of you guys are the biggest contradictions to what we all bitch about, being the decline of the sport we love.
I commend Denny, MJ, and everyone standing up to the Gestapo which has become the France family. Especially with Denny being an active driver putting his own money where his mouth is. And I certainly have no issue with him being a owner/driver. That's been done multiple times in the past.
What NASCAR is bascially telling the teams is GFY, it's our way or the highway. You have to buy from our designs, buy from our parts suppliers, take what profit share we allow you to have, you may not do any innovation that may give you a competitive edge. Hell, you cant even have one of your drivers go race with the Friday night local yokels without our permission.
It's bullshite and is a cookie cutter example of a monopoly. Read what the teams said that signed the charters. NONE of them said it was a good deal for the teams. They all basically said they got tired of negotiating and NASCAR had told them this was as good as it was going to get.
They have to get back to giving the teams a little more input on the sport. I'm a NASCAR OG and was an active participant in the good ole run of the 90's. I remember when Yates engines just produced more HP than the rest, Roush cars just handled better, Childres cars were better in the draft, etc. Teams were allowed to innovate within the rules and it produced a better product on the track.
I'm all for the lawsuit because at least they are trying to help make the sport better. And, i think they're going to win. No fricking way does the France family want the books opened up during discovery.

And Deegan is Exhibit A of what's wrong with the sport. She was fast tracked because she was hot (eye candy for the sponsors) and had a famous name.
Basically Danica without the talent. Danica was at least pretty decent in open wheelers. And, I actually feel sorry for the young lady. In interviews it seems she just wants to race. She should have stayed in the ARCA series and honed her skills and stopped listening to bad advice.
There was actually a lot of talk about Haas taking her under his wing with a developmental program. I guess that fell through.

Well, all the teams could leave and race elsewhere. So there is no monopoly.
If you created an NFL team and wanted to play in it, good luck. You have to get approval from all owners and buy in. And existing teams have to abide by their rules.
Nascar owners could go create their own series which would make nascar owned tracks worthless. There are other tracks to race on. The charter is no different than what all other sports do, giving value to teams. But those teams agree to Nascar rules just like all other sports.
I hate the direction of nascar but that doesn’t mean I have to like the side of lawsuit initiators.
I’ve covered the owning teams before. Denny is an active driver with a conflict. The others were prior drivers owning teams. For example, Rowdy owned teams in Busch and Trucks but not Cup. Denny has admitted he’d help his owned team over team he drives for. If you think about Denny is helping create a monopoly by owning a team while driving thus making it harder for new teams to get in.
Nascar 3rd gen sucks and has mostly ruined the sport. But 23x winning lawsuit would not help the sport either. Their best option is to organize a strike with all other owners and create a board of owners to negotiate with nascar on changes. Then its all owners helping to decide direction not MJ trying to create it his way.
The downside to a strike is Nascar went through this before. And they brought in other drivers and cars. They would find it harder to find cars since they own a lot of series. But they could find some local car clubs and modify rules temporary and race them. That would keep the TV money coming. And might be funner honestly.
It proves the whole point though, its not a monopoly when others and anyone can attempt to race without a charter. A charter is not required to race. Its less a monopoly than NFL and NBA and MLB.

Someone said it, at least Danica was competitive and even then it took a fuel mileage race in Japan to get her only win. Deegan struggled in Nascar hugely and Indycar doesn’t have fenders.
