Is it necessary to pay an attorney a bunch of money to draft a will?

If my plan is to make certain everything goes to my wife and kids, why isn’t legal zoom sufficient?

What happens if you and your wife die and your minor child(ren) are alive?

This is why we went with an attorney. To properly establish a trust in the event both of us die.

Then everything goes to the child. And his godparents assume responsibility. Pretty sure we can spell that out huh?

Serious answer - most attorneys do this kind of work on a flat fee. Call around and find out what's competitive in your area.

You can get it done for $500 outside of big cities. You might even find something in that range in an urban are too.

Disclosure: I Don't have a professional opinion on this, and I am still too young to start considering one.

However, I wouldn't think a Will is something I would be cheap about and try to save a dollar here or there over a route I know would get the job done.

28 here and I did my will/ advanced health directive all together

I have no heirs or spouse, so it will go to my mom/dad but I wanted to make sure there were no doubts about who my condo and assets would go to.

You shouldn't assume anything OP, if you want it done the way you want, you should legally get it in writing.

Also, I went ahead and made it where I didn't wanna be kept alive on tubes or anything either, to just let me go.

The peace of mind is worth it.

I am not an attorney but this is my understanding.

Wills are usually not too complicated or expensive and a portion of the costs is for filing it at the courthouse. But, your estate will still have to go through probate court. My attorney neighbor did mine for no cost except for the courthouse fees. She just filled out forms on her PC.

A revocable living trust is frequently more complicated and more expensive, but the estate does not go to probate court. My neighbor would not do that because trust can be complicated and not her area of expertise.

You will still have court fees even if you DIY.

no, but if you want to properly set up trusts and have a good will that covers everything you want it to, it isn't a bad idea.

Luckily when I did my will my employer had a Hyatt legal plan for $10/month that covered anything and everything I could ever want a lawyer for.

at least in la, most of this is not accurate.

legal zoom will probably will not satisfy la law. write it by hand, date it and sign it. otherwise, go to a lawyer and quit being cheap. for basic will, likely $1000 max. it doesn't need to be filed anywhere until you die, so that's not a concern now.

for medical directive (living will), you can find the standard la form online. it's a check the box thing. fill two out, keep one and give second to your primary care dr.

Yeah, I meant to add that LA law may be different, or NC law may be different than others for all I know.

I don’t know that we had to file the will to make it legal but we did ‘cause the attorney said we should. She actually filed it we just paid the fees.

Really depends on your situation. If you have one kid that is an adult then pretty easy. If you have multiple kids that are adults, then a little trickier. If you have kids that are children, you have some additional issues to work through for which Legal Zoom might not be sufficient. Also depends on what assets and debts you have. If we are talking significant money then attorneys could help you find ways to maximize the inheritance and lessen the burden that actually makes it to your family.

FWIW, I know a lot of life insurance companies will have a will done free to you. If you have any kind of life insurance policy, check in with them...

Yep. Just had mine done through MetLife policy I have. Real easy.
