Y’all sure want to be a stickler about what constitutes cause and behavior detrimental to LSU but don’t want to be sticklers about how the contract determines termination.

Once legal judgements are made, however they go, it would be in LSUs best interest to pay whatever they are required to pay as quickly and as painlessly as possible.

No reason to an a-hole.

This ultimately goes beyond football and LSU and is a reflection of how the State of Louisiana does business. Fair or unfair, that’s the reality.

In theory this could hurt the entire state in more ways than just LSU football.

I’m not cheering anyone on. There’s a contract here, and both parties signed it.

Kelly trying to get what the contract says is his =/= bending LSU over a barrel.

Maybe information will come out that shows LSU is not doing anything wrong, but based on what has transpired so far it sure as shite looks like they are trying to avoid their legal obligation.

And regardless of your personal feelings about BK, you shouldn’t think that is OK

Who said LSU is not honoring the contract? Should Kelly get a full payment lump sum tomorrow?

LSU has 6 years to make Kelly whole. If he wants it sooner he has to negotiate.

Going on vacation when we play a top 15 team the following Saturday isnt honoring the contract.


One of the reasons for cause listed in his contract 11.a.1.e is failure to perform his duties to the best of his ability. Taking a vacation during a 14 week season would not be performing his duties to the best of his ability.

Other places in the contract have references to performance of duties at a comparable P5 or SEC school. So it would be reasonable to compare him to previous LSU coaches as well as upper tier SEC schools. I doubt many SEC Head Coaches are going to the beach on the bye week with a top 15 school next on the schedule.

Theres some other clauses that they may could use as well but I dont think that it helps anyone to go down that road so I wont go there.

It may be tough to prove in court but LSU should keep their options open.

And if this was the case, and it was not approved by his boss, then it could be grounds for notice…followed by a 7 day cure period…etc.

Again, that did not happen.

An employer can’t be fine with your behavior until your performance sucks…then try to fire you for the behavior and not the performance. Especially not when there’s a contract to govern it.

Moscona is a dumbass.

If Kelly wins this lawsuit it just means the school has to acknowledge he was fired without cause. It’s not asking for a monetary award. No money would have to be appropriated by the legislature.

If the school then refused to pay his monthly buyout, he would have to sue again for breach of contract. But it will never come to that because the LSU athletic department isn’t going to just say “nah, we still aren’t paying you” if they lose this first court case.

Sure they can. Here are two simple scenarios

1. Coach, we are sinking and need to demonstrate we are willing to make changes - we need you to fire the OC. Coach says no. That’s grounds for termination with cause

2. Coach, we got smoked vs Vandy after our last bye week, our fans are livid and this time we got Bama - you are not authorized to leave town during the bye week. Coach says no. That’s grounds for termination with cause.

Both of these examples fall pretty clearly into the contract terms, but as act of good faith, LSU could offer a settlement so they don’t have to go down that route, they give a fair offer to protect their reputation.

This is why there was no termination letter, LSU thought they were negotiating the terms, and this lawsuit is Kelly turning the light on.

He prepared more for this dismissal than he did for aTm. think about it.

Did the university then follow the procedures laid out in the contract to handle this?

No - instead they publicly announced the termination and linked it to the team’s performance. It’s hard to put that toothpaste back in the tube.

Neither party looks good here - it’s in everyone’s interests to handle this quickly and quietly. As an LSU fan I’d prefer they stop bumbling through this and move on.

Also, you are referencing two scenarios in which the employer gives an order that isn’t followed.

I was responding to people referencing internet rumors about an affair that has been speculated about for years.
