They will end up in a lawsuit since a judge has already determined they are eligible. And they will once again win that lawsuit.

His assertion may not be a premium legal argument but you can bet lawyers already have valid arguments ready to file on behalf of "wronged" athletes for capricious or arbitrary application of a rule(s).
Athletes sued the NCAA and they can sue a conference. Hint: The NCAA is way under the Mendoza line in the win-loss column.

Don't agree with that but I will point out an SEC policy that would fail in a court if 5 seconds. Another point brought up on the Ole Miss football players is that they would violate the SEC team to SEC team transfer rule where you can't transfer within the SEC without sitting out a year. 
Uh, but yet players can transfer inter-conference without sitting out a season huh? Bottom line: that is a classic "restraint of trade" situation...especially with players getting NIL money.
They better have better ammo than that to use in court. That long-standing policy would have been struck down long ago if anyone ever challenged it. It is illegal and hypocritical on its face.

Only for *mature* individuals. Age discrimination laws don’t apply to 20-somethings.
