I wonder who got to her. Why wait a week to file the restraining order if she was so worried?

You people are crazy. EricB and Cpt. have it right. Whether or not a victim lies, as well as a jury's perception of the victim as a liar or abuser, will have ABSOLUTELY NOTHING to do with this case.

Nothing.

Im not defending Lowery at all, i think he is a piece of shite, but Jesus Christ -- it doesn't change the fact that JJ kicked the dude in the face -- when he was already on the ground incapacitated.

What if they saw him hit the girl? Would it warrant a kick to the head then?

What guy is that? The kind of guy that realizes that this girl was most likely instructed to get a restraining order by LSU defense attorney?

The order for protection was placed BEFORE the fight you moron.

Assault is attempted battery. If someone committs battery, then, they cannot have committed assault because they didn't attempt to beat someone - they succeeded in doing it.

This is entirely incorrect from a legal perspective.

it is immaterial. all that matters is the night of the fight and the pertinent circumstances associated with the fight and injuries. This is not a public opinion or character matter, it is a matter of whether criminal damage was done to someone or not on the night in question.

Where the f$ck do you get your information from? You can have both assault and battery and police charge it that way often. I'm gonna kick your arse (assault), then I do (battery). Or fist raised (assault), fist makes contact (battery). Assault is NOT an attempted battery. It's the placing of one in apprehension of a battery. Read a book.

He could be in a different state that does not have separate crimes for assault and battery. One state where assault merges with battery.

Agreed. You can be a lying, stalking, scumbag piece of shite... but if someone kicks you in the head while you're on the ground that's still assault.

it doesnt make anything JJ did justified

it just goes after the character of this Lowery scumbag...it also contradicts what Lowerys lawyer said about him not being in the bar drinking before the brawl

At what point is a guy on the ground being pummeled not defenseless?

I'm not saying it justifies the kick. But from what I saw in the video.. it doesn't disqualify it either.

He wasn't on the ground being pummeled at all. Nobody was on top of him. He was about to get up, gets the boot, then gets helped up. As I watched it again -- he was clearly getting up on his own.

This sort of personal identification of alleged witnesses and participants needs to end. It's creepy. And it will only encourage some dolts to threaten the implicated indivduals. JMO.

Definitely agree with you on this.

Link?

No right minded individual would suggest that. Nonetheless, it pokes holes in the credibility of Andrew Lowery, the stmt by his attorney that he arrived to pick up friends, and Lowery's version of the police report that suggests they were pulled from their vehicle.

Jeff Palermo, sports director of the Louisiana Radio Network may want to lawyer up. He is the guy that leaked the unedited report to Tigerrag.

Serious question. Has it been confirmed that JJ is the one kicking? If so, why hasn't he been arrested?
