You people are crazy. EricB and Cpt. have it right. Whether or not a victim lies, as well as a jury's perception of the victim as a liar or abuser, will have ABSOLUTELY NOTHING to do with this case.

it is immaterial. all that matters is the night of the fight and the pertinent circumstances associated with the fight and injuries. This is not a public opinion or character matter, it is a matter of whether criminal damage was done to someone or not on the night in question.

I'm not saying it justifies the kick. But from what I saw in the video.. it doesn't disqualify it either.
He wasn't on the ground being pummeled at all. Nobody was on top of him. He was about to get up, gets the boot, then gets helped up. As I watched it again -- he was clearly getting up on his own.

No right minded individual would suggest that. Nonetheless, it pokes holes in the credibility of Andrew Lowery, the stmt by his attorney that he arrived to pick up friends, and Lowery's version of the police report that suggests they were pulled from their vehicle.
