Come on...basic insurance liability principles. I it happens on your property you own some type of liability. An average attorney would argue that the property owners failed to make the property safe.
I'm not judging the merits of the case, but these types of lawsuites are fairly common.

The ankle monitoring company that the 19th JDC uses is a complete dumpster fire in monitoring tPOS on probation or tPOS awaiting ajudication while free on bond. Time and time again, you read how some tPOS got out of their ankle monitor or the company lost track of the tPOS and has committed more felonies and even murders in EBRP while on house arrest.

Went to the mall for a specific item. Had to laugh when I walked in the door and saw a code of conduct sign. Thought to myself, yep that’s gonna help.

What should they have reasonably done? I feel terrible for the parents, but frick attorneys and their 40%.

Have to look at the crime grid in the area to determine if the mall had a sufficient amount of security for that location.

I’m not an average attorney. I’m not one at all. If someone or in plurality walks into anywhere USA and shoots at or kills people that is just criminal. There was no civil duty breached or due legally but whatever let’s keep suing everyone over criminals

Edit to say yes it’s complicated I do have a jd what do you want the national guard in front of a mall would that satisfy not being subject to tort law

There was a mall about 45 minutes drive from where I grew up that was overtaken by gang activity.
Normies knew to stay away from it.
Turned into quite the chaos zone until the city bought out half the mall property and turned it into a Police Station.

Pretty damned novel way to fix that problem. Worked like a charm!

I am not saying that the mall should be sued, I am simply saying that these types of lawsuits have been successfully adjudicated or settled in the plaintiff's favor in the past. I am playing devil's advocate here, but in regards to what they could have reasonably done? If I am the plaintiff's attorney, I am asking these questions to the mall operators:
1. Some malls have metal detectors to screen for guns. Did you?
2. Some malls have enforced curfews for teenagers. Did you?
3. Some malls require an adult escort for anyone under 17yrs of age. Did you?
Private businesses have the right to allow or refuse people access to their property.

Here's a scenario...if you were the parents, God forbid, and you had a choice of being paid 5 million dollars or you can have one hour (no holds barred) with the scum who fired the weapon that killed your child, what would you take? Now, this is one hour to come to any conclusion possible with no penalty against you at all, even if the perp ends up choked to death!

So we're gonna sue the mall for the retard backwards subculture that exists all across this country and engages in totally illogical and uncivilized behavior, which is generally subsidized and accepted by popular culture and political leaders, local and national?

Are we going to allow private enterprises to explicitly forbid these people from their properties with extreme prejudice? If not, then the blame obviously belongs elsewhere. It's pretty amazing that we aren't on track to ever change anything about what happens with this subculture and how they are allowed to spread and destroy everything they touch. Suing the mall is just an example of how we aren't allowed sociopolitically to hold the actual perpetrators and enablers of these crimes accountable. We'll just run off all private enterprise within any proximity to said subculture and the spreading will continue.

I'm guessing they're probably protected.

Best that can be done is publicly shame them, though I doubt any of them have any shame. But yeah...in ranking who was at fault for this murder:

1 - Murderer
2 - Judge and/or DA





















3 - Anyone or anything else.
