Which, unlike Kiffin's quips, actually does break a specific SEC rule.

Correct but the SEC doesn’t care about that. This goes much deeper. There are political views involved as well and fans are starting to put the pieces together.

Can’t have a bunch of red guys in a red state pushing back on leftist leaders. You’re kidding yourself if you don’t think that’s a huge part of this. Our past leaders would have just bent over. The new ones won’t and the SeC is pissed.

To strip out all the legalese...we really, really want to punish LSU and this is the best we can come up with

So the Wisne v NCAA case was in Colorado Federal court in July and the judge ruled that the NCAA could not use any other means or bylaw to rule the 2022 class ineligible for their 5th year. The NCAA appealed and the judge granted the injunction a stay pending appeal. The NCAA has until Sept 15th to file an answer. Tell me again, how in the hell is this LSU’s doing?

Agree completely.
I believe what the poster intended when he said "LSU and Kiffin Instigated this mess", is that they sued the SEC when the SEC hurried and voted to create a rule concerning pro-players coming back to play college ball.

LSU, you could say, did instigate that somewhat. But it was in response to the SEC wanting to ignore the NCAA 5 for 5 ruling.

So in summary,
This lawyer is saying the Fed suit that the SEC filed is not about the actual act to get Wright and Harris on a roster, but is about what happened later and the public talks that Lane had with the media? Claiming lack of institutional control.

If the School Presidents/AD's really understand that the SEC wants to punish LSU and administration for discussing in public of how the SEC or NCAA have handled something, will the schools really be OK with this arbitrary and broad accusation of "Institutional Control" in order to punish a school?
Are they going to think about what that might mean for them in the future?
Is there more to their suit than this that I'm missing?

Neither LSU nor Kiffin sued the SEC.

The NCAA instigated this mess with the idiotic timing of the 5-for-5 roll out.

The Root Cause of all of this is the NCAA not knowing their @$shole from a hole in the ground. The powers that be at the NCAA must not know what a calendar is. They screw up everything ie. transfer portal, etc.

If speech is going to be punished how many games does the Tenn coach get for encouraging assault?

It can punish a violation of its rules.
A rule that did not exist, until it did, and then LSU did not break that rule. So....., what's left? They don't like the speech coming Kiffen.

I’ve wondered the same thing. If they can get past the Kiffin hate for two seconds, it’s just common sense to realize this means that no one is safe. Greg Sankey is going to be remembered as the commissioner who allowed cracks to form in the foundation of the SEC.

Well his premise is wrong regardless, because the above never happened.

At no point was this fight ever LSU/Kiffin vs NCAA/SEC, and that's the narrative that needs to go away. Lsu and Kiffin have not currently oe previously sued the NCAA or SEC, the athletes however have and that's who this fight has always been between.

of course not, the pitchforks are out and the torches are lit. Why would they ever think any of the other schools would use this against them.......
