No, it is tampering until the NCAA finds the intent to be there or not. Either way it was a violation, and will now be up to the NCAA to determine if it was malicious (like in the Bryant case) or simply a case of unintentional discussion.

a month ago I would have said LSU 31-27, but now my gut is telling me Oregon 34-24. I really hope I'm wrong, but the last 10 days have been the last thing this team needed right now.

If we are found to have a violation, not necessarily a player violation, LSU would be in deep shite and get repeat offender status, even for small things. Basically, LSU is under a microscope and is held to a higher standard.
That said, LSU is not playing Shepard to avoid this potential problem should the NCAA feel he should be ineligible.

I think the biggest problem here is just the pure distraction element all of this crap has brought to the team. The players missing is obviously an important element, but we are just over a week from this game and it is just distraction after distraction....
