Number of times transferring really doesn't affect that much. All the athlete has to do is get a waiver from the NCAA to be eligible immediately. I saw a report a while back about this and they said that from what they had seen virtually all the appeals were getting approved for the most part.

Yes, they did change it. Or, more accurately, they made it obsolete.
The NCAA has had a one-time exception (bylaw 14.5.5.2.10) for immediate eligibility for quite some time. However, previously, the one-time exception was not available for players participating in baseball, basketball, bowl subdivision football, or men's ice hockey. The grad transfer rule (bylaw 14.6.1) allowed players in the excluded sports to use the one-time exception as long as they were enrolled in graduate or professional school.
When the NCAA implemented the "new" one-time exception for immediate eligibility, they didn't actually create a new rule. They just changed bylaw 14.5.5.2.10, deleting the part that excluded baseball, basketball, bowl subdivision football, and men's ice hockey. In other words, they extended the existing one-time exception to all sports.
This made the graduate transfer exception obsolete. The current iteration of the graduate transfer exception (still bylaw 14.6.1) states the following:

A student-athlete who is enrolled in an institution other than the institution from which the student-athlete previously received a baccalaureate degree and is enrolled in a graduate or professional school, is seeking a second baccalaureate or equivalent degree, or is enrolled as a full-time student while taking course work that would lead to the equivalent of a major or degree may participate in intercollegiate athletics if the student-athlete fulfills the conditions of an exception for transfers from four-year colleges set forth in Bylaw 14.5.5.2.

A transfer student (other than one under disciplinary suspension per Bylaw 14.5.1.2) from a four-year collegiate institution is not subject to the residence requirement for intercollegiate competition, provided the student met the notification of transfer requirements per Bylaw 13.1.1.3.1, does not have an unfulfilled residence requirement at the institution from which the student is transferring (except for the return to original institution without participation or with minimal participation exception) and any of the following exceptions is satisfied. During the student-athlete's first academic year of full-time collegiate enrollment, such conditions may serve as a basis for an exception to the residence requirement only for transfer students who, at the time of initial collegiate enrollment, met the requirements for qualifiers (set forth in Bylaw 14.3.1) in Division I.
This is the bylaw that defines all of the existing exceptions to the academic residence requirement (the 1-year period that a player would have to sit out). There are exceptions for exchange students, students in academic programs that have been discontinued, military service, discontinued sports, nonscholarship players, etc.
The notable exception under 14.5.5.2, though, is 14.5.5.2.10 One-Time Transfer Exception. Now we are right back where we started. One of the requirements to qualify for the the one-time transfer exception is:

(a) The student has not transferred previously from one four-year institution unless, in the previous transfer, the student-athlete received an exception per Bylaw 14.5.5.2.6 (discontinued/nonsponsored sport exception);
So basically, bylaw 14.5.5.2 defines all of the situations where a player can transfer with immediate eligibility. The graduate transfer rule, bylaw 14.6.1, says that a graduate transfer can be eligible immediately if he qualifies for one of the exceptions under 14.5.5.2. Which is now redundant, because any transfer player can be eligible immediately if they meet one of these exceptions.

Now, if an athlete has already use a one-time exception for a transfer as an undergraduate, the athlete is not automatically eligible as a graduate transfer. Athletes can still apply for a waiver to become eligible under certain circumstances.
I suspect that graduate transfers who have already used their one-time exception are enrolling in graduate programs not offered by their previous university, and applying for a waiver using that as their justification.
