What looming threat?

Dems claiming there is a looming threat does not mean there is a looming threat.

Now explain this to me like I'm Michael Scott's spermatozoa

Won't OSHA come in as a result?

The President is planning to give OSHA authority via an Executive Order to issue an emergency temporary standard (ETS) to make it legal to fine businesses that have unvaccinated employees. The question is: is this expansion of OSHA provenance legal or does such an expansion require legislative definition?

Emergency Temporary Standards

quote:

Under certain limited conditions, OSHA is authorized to set emergency temporary standards that take effect immediately and are in effect until superseded by a permanent standard. OSHA must determine that workers are in grave danger due to exposure to toxic substances or agents determined to be toxic or physically harmful or to new hazards and that an emergency standard is needed to protect them. Then, OSHA publishes the emergency temporary standard in the Federal Register, where it also serves as a proposed permanent standard. It is then subject to the usual procedure for adopting a permanent standard except that a final ruling should be made within six months. The validity of an emergency temporary standard may be challenged in an appropriate U.S. Court of Appeals.

The idea is to force the Biden administration to "put up or shut up" by forcing the issue into court. Ideally the resolution would create a barrier to the limits of Executive Orders.

***EDIT***

I jumped the gun a bit, changed "gave OSHA authority" to "is planning to give OSHA authority".

I know. I just want us to stop acting like it's crazy that free Americans may actually be pushing back against some of this crazy.

True but legally it’s different and that’s what other federal contractors are doing.

Did he actually sign an executive order for this? Or did he say he would sign an executive order on this and then just slow walk the actual signing. He knows it is unconstitutional but you can't sue and get an injunction until he signs it. So he announces it and business do it because they think its coming, but it is never actually law.

He signed an EO aimed at Federal Contractors of which SW Air is one.

The 100+ employee OSHA rule hasn't landed yet, but the federal contractor mandate has.

Hmmmm...I wonder if this will solve all those pesky weather delays from the past few days.

I have a colleague who hasn't been able to fly back from Reno to the Birmingham (clear blue all the way, equipment grounded) for two days now. Not the worst situation in the world, though, if you've been to Reno, you know it's not ideal.

The pilots need to keep hammering SW. While this is a start, it's still pretty vague.

Make them cry and beg for mercy.

It can work! It will take the locking of arms (as repeatedly demonstrated by the dems). Stay strong. Stand for what is right in every business. If pilots stand - stand with them! Then when programmers stand, stand with them. When medical professionals stand, us too! Don’t give them little fires- BURN!!!

It's a bit of both. The primer was the EO he signed in September for federal employees ( LINK) but the business mandate (OSHA threat) is part of his stated plan ( LINK) which he said is coming.
