That’s what needs to happen given the justification written by Kav.
Go ahead and evict and let people sue.

Can SCOTUS step in without it running through lower courts first? Can that proactively go after this being they already ruled on the exact same thing?
Posted on 8/3/21 at 6:14 pm to TheHarahanian
This country has gone to crap.

Normally I would agree.
The CDC blatantly thumbing their nose at a prior ruling? I think that gets fast tracked.

My understanding is that they have already ruled on this exact situation before, which means it doesn’t need to be relitigated.
Unless there is a substantial difference between this moratorium and the last one, this shouldn’t take long.

I hope so but don’t expect it

Yeah, I mean the federal government could come in but not sure where they have jurisdiction even.
Unless they send an order to me directly there is no way in the world I would stop.

Thanks Kav for being a spineless POS.
He drank whatever Kool-Aid Roberts was giving him.

I agree with the District Court and the applicants that the Centers for Disease Control and Prevention exceeded
its existing statutory authority by issuing a nationwide eviction moratorium. See Utility Air Regulatory Group v.
EPA, 573 U. S. 302, 324 (2014). Because the CDC plans to end the moratorium in only a few weeks, on July 31, and
because those few weeks will allow for additional and more orderly distribution of the congressionally appropriated
rental assistance funds, I vote at this time to deny the application to vacate the District Court’s stay of its order. See Barnes v. E-Systems, Inc. Group Hospital Medical & Surgical Ins. Plan, 501 U. S. 1301, 1305 (1991) (Scalia, J., in
chambers) (stay depends in part on balance of equities); Coleman v. Paccar Inc., 424 U. S. 1301, 1304 (1976)
(Rehnquist, J., in chambers). In my view, clear and specific congressional authorization (via new legislation) would be necessary for the CDC to extend the moratorium past July 31.

I mean... how fricking stupid can he be? He agreed the CDC overstepped its authority by issuing the moratorium but then said "hey, since it's almost up it can stay." That's an in-fricking-sane precedent. How does someone on the Court even take that into consideration?
And then he tosses out some wide-eyed naivete with their needing "clear and specific congressional authorization (via new legislation)" to extend it. They are extending it without any new legislation.
Now it's got to go back to court all over again.

If I were a landlord I would just proceed, assuming a State court isn't stopping the process. Let them sue and seek an injunction, they would first have to kick out to federal court.
Than all you have is incomplete notice without the ability of having an administrative hearing.
This would actually all have to go back to the administrative level i.e. agency hearing.

Yes and AOC and Gang told Biden to ignore them.
Really - who is going to do anything about any illegal activities by these people? The woke military? The CORRUPT FBI and CIA? Who?

If we no longer have laws, why are these people still in power?

Almost like a reimagined version of Imagine
Imagine there’s no country, it isn’t hard to do
No laws to live by , no need to ask why
Politicians and government employees , which one are you

Constitution...smonstitution...
I find it amazing that the only rights leftists think are important, and worth making a constant scene about - are nowhere in the constitution, but somehow they think the ones that are listed in there are just throwaways at best, and at worst racist to try to enforce.
Leftist Bill of Rights:
1-abortion
2-feelings
Nothing else matters
The actual bill of rights protects
1-speech - religion
2- Guns
3- property
In that order
They really are Imbeciles, over emotional freaks

They can't. They've already ruled on it.
Posted on 8/3/21 at 6:25 pm to TheHarahanian
All the laws and rules are completely useless at this point. Dems ignore and Rinos look the other way. Frick everything!
Posted on 8/3/21 at 6:25 pm to TheHarahanian
And you won't see one cuck Republican in front of the camera raising hell. Oh wait, we have Garret Graves to the rescue!

Because everybody lives in fear of the government in this country unlike in Europe where the government fears the People.

To quote the New York AGs office regarding Cuomo:
quote:
James said Tuesday that while Cuomo’s behavior violated state and federal law, the report did not reach a conclusion on whether Cuomo’s conduct should lead to criminal prosecution.
There is clear precedent of them breaking the law, the justice department acknowledging they broke the law, and the justice department deciding to allow it.

How long do people need rent-free housing? It's time to start burning shite down.

Why is the cdc involving itself in financial and landlord tenant business?
It’s ridiculous, owed a nice chunk of change at the moment on stuff I could’ve sold before the start of this and made $ and can still do the same if it ever ends but at the moment it’s pathetic, glad they are paid for…
