Other than the knee jerk title, hate crime doesn’t actually hold that tough of a penalty.
It’s not nothing but normal charges murder charges hold wayyyyyyy more weight

My guess is because he wasn’t just a bystander. He was working with them to track down and detain him (if I recall correctly from the longer video that was released later).

That seems like the biggest reach in this case, but I'm not a lawyer.
Following the dude and assuming he was a criminal is one thing, but being equally responsible for the actions of the mcmichael frickwads is another.

During the alleged murder? No, not to my recollection. However, previous statements made by the defendants can easily be construed as a pretext for "hate crime", which, given the climate, is going to make the tacked on charge pretty easy to argue.
ETA: BB making me look like a dumbass. Didn't realize that some of the language occurred during the incident.

Maybe you missed the recent news where he’s used his “out for a jog” excuse when he was trying to steal shite before.
The hate crime charges are a joke. You can argue whether or not there was any authority to chase after him, but the charges they’re going after are silly.
