Cardelle Hayes manslaughter conviction thrown out

The man convicted of manslaughter for killing New Orleans Saints great Will Smith in 2016 is no longer a convicted killer.
Cardell Hayes was charged with second-degree murder after shooting Smith during an altercation that followed a traffic incident in the Lower Garden District. But an Orleans Parish jury ended up convicting Hayes of a lesser crime, manslaughter, on a split 10-2 vote.
Since then, the U.S. Supreme Court found Louisiana’s non-unanimous jury verdicts unconstitutional in the Ramos v. Louisiana case, allowing all convictions still on appeal to get a new review in light of Ramos. The high court looked at Hayes’ case Monday morning and vacated the conviction, sending the case back to the 4th Circuit Court of Appeal in New Orleans for review.
The 4th Circuit is expected to grant a new trial, as appellate courts have in several other split-jury cases. In July, Ronald Gasser, who also killed a football star, former NFL running back Joe McKnight, after a road rage incident in Jefferson Parish, was already granted a new trial by the 5th Circuit Court of Appeal in Gretna.
It will be up to Orleans Parish District Attorney Jason Williams, who is just being sworn in Monday, whether to pursue a new case against Hayes. Because the jury convicted Hayes on a “responsive verdict,” reducing the charge from second-degree murder to manslaughter, Hayes’ appellate attorney Eric Santana says Hayes could only be charged with manslaughter the second time around.

Not really interested in celebrating or condemning this decision
Just a really sad situation that both guys contributed too.

I have no idea whether it was self defense or not. Hopefully the courts are getting it right. Bad situation all the way around.

I remember quickly just labeling him guilty, but Will really f'd up by going back to his vehicle in a potential attempt to grab that weapon. Like someone said it's just terrible on both sides. Preventable if Hayes didn't follow him out of rage.

Last I checked big Will didn’t have rape warrants out for his arrest and was shot in the back with no weapon in his hand, so why did the Saints have a rapists name on their helmet and Lebron said we live in two different America’s after their ‘hero’ was shot by police in a similar situation??? Please explain this to me.....

if both would have settled this the old fashioned way with fists than it would have saved two lives
one that died
and one that was sent to prison for life
I'd be shocked if they try the case again and he gets off, maybe a reduced sentence from life
over a small minor fender bender that Will Smith could have paid for out of pocket

Payton will probably lecture us on how nobody needs a gun in 2021 and leave it at that

It’s a sad situation all around. No one wins in this situation, but it was the right decision. If this wasn’t Will Smith and Sean wasn’t in the court room, the conviction likely doesn’t happen.

Manslaughter carries up to forty, crime of violence time. And that's assuming he isn't bitchable.

I thought he was innocent then, I think he’s innocent now. Smith’s hot head friend got him killed.

I recall Lester being extremely “Team Cardelle”
Proof positive that he only exists to annoy the shite out of everyone.

Thank God they dropped this. Dude is innocent but his life is ruined in Louisiana now.

Will Smith was a completely drunk jackass that night that started a bad chain of events, but he's not the one that got out of his car after running into the back of someone that night with his gun in his hand like Hayes and he didn't put 7 bullets in anyone's back or shoot their wife either. Hayes tried to claim that Smith was punching him, yet Hayes friend who was with him said he didn't Smith throw any punches. Hayes lost control though and messed up numerous lives.

They only convicted him of manslaughter the 1st time around and he got 25 years.
