And now he says the CDC says masks keep germs out as well as in.

First they told us don’t wear them because they don’t work.

Then they told us we had to wear special masks because basic coverings don’t work.

Then they told us any old piece of cloth works. Tee shirt, old pair of drawers, whatever. BUT they only keep your nasty germs from infecting others.

Now, the masks are extraordinarily effective at being keeping virus out AND preventing virus from coming in.

I wonder what’s next?

.@LouisianaGov: Good news is we believe one or two vaccines be available by end of year. In meantime we have to follow mitigation measures we all know works. We need people to step up now. #lagov #lalege

.@LouisianaGov: Also been couple of weeks since House petition (trying to overturn order) which caused confusion. Good news is that found unconstitutional. There's no doubt that petition in and of itself led to diminished adherence to mitigation measure #lagov #lalege

What a douchebag

Again, if private social gatherings around Halloween are the primary cause of the spike, why are we discussing shutting down businesses?

The ruling was the repeal part of the statute was unconstitutional. Statute says either house or senate can end the EO with a majority, judge says both sides have to do it.

Correct.

quote:

A. The governor is responsible for meeting the dangers to the state and people presented by emergencies or disasters, and in order to effectuate the provisions of this Chapter, the governor may issue executive orders, proclamations, and regulations and amend or rescind them. Executive orders, proclamations, and regulations so issued shall have the force and effect of law.

B.(1) A disaster or emergency, or both, shall be declared by executive order or proclamation of the governor if he finds that a disaster or emergency has occurred or the threat thereof is imminent. The state of disaster or emergency shall continue until the governor finds that the threat of danger has passed or the disaster or emergency has been dealt with to the extent that the emergency conditions no longer exist and terminates the state of disaster or emergency by executive order or proclamation, but no state of disaster or emergency may continue for longer than thirty days unless renewed by the governor.

He basically ruled that because EOs have the force and effect of law, the petition would need both House and Senate signatures to be constitutional.

The gut shot is that now (I think), they'll have to revise the statute through legislation which will have to be signed into effect by JBE.

Or just get the Senate to join.

They better at least get the Senators to put yays or nays on the record so we can see who needs to go.

Doesn't the ruling essentially throw out the petition portion of the statute?

I don't think it's as easy as getting the Senate to sign because it's gone before a judge and ruled unconstitutional as written.
