quote:18-1-704. Use of physical force in defense of a person
At no point was his life in danger and pepper spray is not lethal, also he shot the guy after the pepper spray. your assumptions are based off emotion not facts.
(1) Except as provided in subsections (2) and (3) of this section, a person is justified in using physical force upon another person in order to defend himself or a third person from what he reasonably believes to be the use or imminent use of unlawful physical force by that other person, and he may use a degree of force which he reasonably believes to be necessary for that purpose.
(2) Deadly physical force may be used only if a person reasonably believes a lesser degree of force is inadequate and:
(a) The actor has reasonable ground to believe, and does believe, that he or another person is in imminent danger of being killed or of receiving great bodily injury; or
(b) The other person is using or reasonably appears about to use physical force against an occupant of a dwelling or business establishment while committing or attempting to commit burglary as defined in sections 18-4-202 to 18-4-204

Pepper spray is not “great bodily injury”.

Pepper spray is not “great bodily injury”.
I was simply correcting a misstatement of the law by Ninthward.
Colorado statute defines “bodily injury,” but does not seem to define “great” bodily injury. I suspect this will provide a lot of leeway.

“Great bodily injury” isn’t something cured by a jug of milk.

Oh good grief. If this was the other way around everyone would being saying it was justified.

Serious Bodily Injury”– has the same meaning as defined in section 42-4-1601(4)(b), C.R.S., namely: injury that involves, either at the time of the actual injury or at a later time, a substantial risk of death, a substantial risk of serious permanent disfigurement, or a substantial risk of protracted loss or impairment of the function of any part or organ of the body, or breaks, fractures, or burns of the second or third degree.

I wouldn’t be. So your statement is incorrect.

Who gets to decide that?... the guy will get his day in court.

Common law if it’s undefined, or they can extrapolate the definition of “serious bodily injury” above.

Serious bodily injury
You have convinced yourself that they are the same, bc you WANT them to be the same.
The rules of statutory interpretation beg to differ.

Considering Dolloff was observing the initial incident and approaching from the rear of the victim I think the most likely initiator is Dolloff.

its riotously funny to see that the guy walking around with bear mace covers his face, points it at the security guard and walks up to him, then slaps the shite out of him, and the kyle rittenhouse crowd are all acting like they wouldnt be cheering if the sides were reversed after he gets shot.
when the cops shot the guy with a taser in the back outside of Wendys in Atlanta they all said "well he could have tased the cops then taken their gun", but suddenly that scenario doesnt apply, even though the Wendys guy was trying to avoid a fight and this guy is trying to find one.

9News is now in a quandary.
I predict they don’t have ledger entries for Pinkerton and I predict Doloff never worked for Pinkerton.
But they’re saying they hired him. So are they going to be party to the lawsuit from deceased’s family? I would guess so.
But they probably don’t want to go back and admit they never really hired this guy.

Which is more severe, generally?
Hint: if it doesn’t meet the definition of “serious”, it sure as shite won’t meet the definition of “great”
