quote:
An 18-year-old man made his first appearance in federal court Friday on an arson allegation, accused of lighting and throwing a large firework Tuesday over the fence at the front of the Mark O. Hatfield United States Courthouse in downtown Portland.
quote:
Agard-Berryhill told federal officers that an unknown man in a ski mask handed him what he thought was a spinner-type firework that would rotate with varied colors when lit. Agard-Berryhill said he was going to light it and throw it in the area of Southwest Third Avenue, but others told him that some people in the crowd have post-traumatic stress from tear gas launched by federal officers and directed him instead to throw it over the fence toward the courthouse.

You missed another good part -
Dude's 18 and already had another felony offense.
quote:'
U.S. marshals contacted a probation officer from the Oregon Youth Authority’s North Valley office, where Agard-Berryhill had been supervised for an unspecified felony offense, according to court records.

This is the dude that got busted because his memaw bought him a poser tactical vest, reviewed it online where she posted a picture of him wearing it, then that photo was used to identify him in the video of the incident

his memaw
...took the pic of him sitting on the hood of his car while wearing the vest and a mask. She knew about, and probably encouraged, his plans for soy thuggery. Arrest the bitch for accessory.

That’s a fool proof defense. Somebody gave it to me and somebody else told me to throw it.

It's 2020, probably solid advice for any defendant.

An arson charge is pretty serious.
But he’d ask for a jury. I wonder if this district is like others, where you get a mix of urban and very rural. I can imagine a Portland dominated jury acquitting, but I’d bet there are some backwoods Oregon baws that would put him away.

Read the complaint. The most interesting things is that the feds say the property line extends out into the street. The USA literally owns those streets, or part of them. I did not know that.

The only better one I have heard is the guy who got busted because he had a shirtless pic posted and he has his last name tattooed across his upper back.

Not much different than counties and cities owning, as one OT brain trust put it, "right aways" all over the place.

So can the feds shut down part of a street if they own it? I doubt the city has easements against the feds. And you can’t adversely possess (acquisitively prescribe, for Louisiana baws) against the sovereign.
