Oh I have no doubt the en banc court will reverse the panel. And the Supreme Court won't reconvene until after the election. So Flynn will be silenced. The land of the free my arse.

Pure politics.
Comey and the other top kunts of the FBI worked hard to pretend that Flynn did something wrong even after the initial FBI investigation proved he did nothing wrong. Used that to force the investigation into Flynn to continue, and even threatened Flynn's son, if Flynn didn't agree to plead guilty.
I don't even give a frick about process crimes. If you want me to give a frick about process crimes, then start rounding up comey, clapper, brennan, strzok, etc... who provably lied under oath. Until then, I don't give a frick about this lopsided sense of justice.

The issue is whether mandamus was proper.
If Sullivan gets this back in his court and does something Flynn objects to then Flynn can appeal that judgment.
Sullivan could still dismiss the action. If not I guess it still would be possible that Flynn get no jail time for what he pled to and Flynn would have no need to appeal.

That’s what I don’t get. Who are the parties in the appeal? Is the judge basically trying the case instead of the DOJ?

The FBI didn't think he lied. But even if he did, the lie has to be material to an investigation. If I tell the FBI the sky is red when it's blue, that's not a crime. The alleged false statements Flynn made were not material to an open FBI investigation at the time. These documents didn't come out until after the plea. That's why the DOJ filed the motion. They couldn't prove materiality.

Essentially. He wants Flynn held for perjury for pleading guilty initially even though he knew that was not the truth.
The problem is Flynn hasn't been charged with perjury. Sullivan may have slapped him with contempt.

Flynn's lawyer put it out in court documents that Flynn was set-up. He was told to say A, B, C, D, E, F, G, or his son that just had a newborn baby would go to jail Manafort style--straight to solitary. Combined with a perjury trap.
The DOJ officially took back the charges because Flynn was set up. The person(s) that did this are in their cushy homes driving their Bentley's to their cushy law firms; and or getting six figures from MSNBC & CNN and go fund me's. Unscathed and currently above the law.
This was DOJ/CIA/FBI political activism turned judicial activism.

I think the Rao decision was pretty bad.
There was enough here for the full court to grant review even considering it is expressly disfavored.
