A lynching is defined as the killing of someone by a mob without a fair and legal trial. I mean I guess you could argue that 2 guys with a gun isn't a mob, but they certainly appear to have taken justice into their own hands and killed a guy without a fair and legal trial.

Uh, no. If he was a burglar they’d be cool with me. Apprehend the guy, and when he resisted, and charged the gunman, shoot him. But that’s not what happened. They had no real evidence that this guy committed a crime. A citizen can’t just arrest someone because he suspects they might be up to no good.
