DA elects not to prosecute because it was a legit mistake. Talk about a frick up of the first order.

As noted in Weintraub’s letter, Section 304 of the Pennsylvania Crimes Code (Title 18) states that a person has a defense to a criminal charge if he makes a mistake as a matter of fact for which there is a reasonable explanation or excuse.

That is bs. And it opens up a can of worms. How can you excuse this and not excuse a civilian saying they were reaching for their nerf gun, potato, wallet, etc.

While I back the blue, this individual does not have the mental acuity to know the difference between a taser and firearm in a slightly elevated stress situation.
He is a danger to himself, and others around him in any kind of LEO capacity. He would probably be fine in a white, or blue collar job.

This...if he was so mentally flustered then he shouldn't be a cop. At least not on the streets. Put him behind a desk. That is a massive mistake that could cost someone their life

And if the cop had better ammo he could have twofered the shot. Hit the perp and his partner who was trying to hold the perp.
I can tell you if that happened to me I (as the cop holding the guy), I would beat the shooters arse when I was able.
