Neighbor's live oak tree roots cracking my driveway.

My neighbor has a 75 year old live oak that is close to my driveway which is just within my property line. That tree is only 3-4 feet from my driveway where the concrete slabs are starting to show cracks and uplifting. I built on my lot with the driveway 20 years ago. Is my neighbor liable for the property damage?

The way it works with branches or falling on your property is this; they are not liable for damages. They are liable for cleanup of it falls but that’s it.
Call an arborist perhaps? Not some tree cutter but someone who deals with tree health. You might be able to sever the root.
I do not know what liability you may have for cutting the root system on the tree. I know with branches you can trim them if they’re on your side of the proper line.

Also, since you built the driveway 55yrs after the tree was planted, why did you build it on top of the roots.

Take the affected slabs up, put down gravel, and expect people who appreciate considerate neighbors to place you on a pedestal.

Switch to a gravel driveway in that area. Not a big deal and the tree can live

I'd bet that mature oak tree is helping your property value more than it is hurting it.
