Lol it's as easy as he did his damndest to conceal his efforts....thus he knew it was wrong. Im shocked his attys would even think abt going down this road, and the DA must be pissing herself laughing.

There isnt even a 1% chance this succeeds in trial. Where it may come into play is making this assertion way pretrial, send ole boy to rehab, and then go hat in hand to the DA and convince them that it was a negative force in his life, that he's admitted his addiction and come to terms with it, and has and is addressing it in xyz ways. And pretty please will you offer a lesser plea due to the aforementioned. But crowing about how you intend to mount this defense at trial isnt a real good way to get kind treatment from DA.

In fact, he wont even be allowed to use this defense if it made it to trial. Gotta serve notice upon DA of intent to use this defense followed by a pretrial hearing wherein DA would prevail. This defense is used at actual trial only 1% of the time and of those cases approx 26% are successful. Nope, his attys know full well this cant and wont be allowed in trial BUT his attys are hopefully getting it into the minds of potential jurors right now. From ine criminal trial lawyer to another, his atty is planting the seeds of "jury confusion" aka the only viable strategy we have most of the time.

No you see your honor on the occasional weekend, i like to do rails off of a strippers arse. Clearly I can't go to jail for this completely unrelated reason.
