Did you read the depositions? You are wildly mischaracterising her statements.
She wasn't speaking about Title IX.
The Missouri conduct code lists 2 descriptors for sexual harassment including (1) misconduct by someone in a position of power or authority over another.
Now, to 99% of people this would refer to professors harassing students, bosses harassing employees, etc. This woman said that being physically larger than someone you were harassing could constitute being in a "position of power" over them. There's not going to be much of a leg to stand on there, but it sounds a lot less ridiculous when fleshed out, doesn't it?
It should be noted that the original investigator, supervisor who heard the appeal, and the woman who replaced the original investigator were all deposed, and only 1 came up with this strange reading.
Mizzou is gonna get effed in the a on this one for sure, but not because of some dumb internet outrage. The 4 year ban the black student got was wildly out of line with the only other 2 cases similar to his - a white student who was referred to counseling and a second white student who got 2 years despite also being found guilty of sexual assault and gross sexual misconduct.
