If you listen to the longer video she tells him the patient has already been given something to make him more comfortable. It would make no sense to draw blood at that point because the hospital has introduced drugs into his system. The cop then tells her that all that would go away in civil proceedings when it would be cross checked... so in other words, they wanted blood drawn in order to claim the victim was on drugs and are therefore not liable for his injuries. As far as it going away in civil proceedings, we all know that's bullshite. That would be used to tie this up in court for years to come. It wouldn't magically go away.

The guy was unconscious. He cannot legally consent to the procedure. If she were to have provided law enforcement with his blood, the hospital would have opened itself up to a lawsuit.

This happened in July. The detective still has a badge and it's September. If you don't think there are cops who feel emboldened by the sense that they won't be punished if they cross a line and that their department will form the blue line around them if they mess up, then I don't know what else to say.

It's one case. You're extrapolating to the entire country. Now, you'll respond with other cases, yet still a small number that you'll extrapolate to the entire country.

The story needs to be more detailed. Hospitals routinely do lab work on unconscious patients brought in to the ER. I suspect that the clarification should be, blood work for police investigatory purposes.

My point is, do you think this cop would have done what he did if he thought he'd be arrested and lose his job? I think the answer to that question is no.
So then why would this cop do what he did? I think it was because he sincerely believed that nothing serious would happen to him even if he broke internal policy and the law itself.
I've seen the same thing here practicing law. Police departments here will arrest people with no charge, detain and interrogate them, and then slap a phony resisting arrest or disorderly conduct charge after the fact to try and justify the initial detention. Almost all of these are later dismissed.
We have to hold police more accountable than your average citizen because of the power they wield over us. I don't think our society does a good job of that at all.

My question is where are her bosses and her bosses bosses. That is complete BS.
That cop talking about messing up HIS investigation and messing up HIS laws. frick HIS laws.
She should sue the hospital the city the police dept and anyone she can over this.

There was a police chase which resulted in a crash which caused the injury to the patient. The patient was an off duty cop. Cops always get bent out of shape when another cop is injured. The article mentions that the cop "was trying to protect him" by drawing his blood.
