Even CNN admitted the old DC protocol of when a lameduck POTUS can or should appoint a SCOTUS nominee; regardless of any circumstances. The short amount of time didn't leave the SCOTUS in any real bind. So, this is why Obama didn't appoint Merrick Garland.

The Senate votes on it and a simple majority is required. Look it up. There are plenty articles explaining it.
