I don't know. I don't know the definition of manslaughter. I do have a problem with him being charged with one thing and when the state can't prove that charge they can fall back on something else.

To me you should only charge what you can prove, if you fail then get better at your job.

On another note, was he sentenced yet? If not, when will he be?

Didn't realize you had inside sources in the jury. Regardless, not one person said what Janky claimed.

Never claimed to know everything. In fact, I have stated several times that I don't know much about this. That is why I ask so many questions. However, I also get to have an opinion and I believe the call that the collision was intentional is bullshite.

I followed the whole trial mostly through this thread and I think the corrrct conviction was reached. Obviously I did not hear everything that was said but I think this was a classic case of "when keeping it real goes wrong"

No, because the other person was not acting aggressively

Had they been acting aggressively, would you have gotten out of your vehicle brandishing a gun? Or stayed in vehicle and called police, possibly holding gun for your protection?

Not trying to be a smartass, real question.

I know BS when I see it.

quote:

The jurors, who deliberated for 5 hours and 40 minutes, also voted 10-2 to convict Hayes of attempted manslaughter for shooting Racquel Smith, but unanimously acquitted Hayes of aggravated criminal damage to property, deciding he didn't intentionally ram the Smiths' Mercedes-Benz SUV with his Hummer H2, after contending that a drunken Smith rear-ended him first on Magazine Street.

The only unanimous verdict was that of not guilty for the criminal intent to damage

He would have been in a much better position had he stayed in his vehicle. Same can be said for Will Smith. If you believe someone rammed you intentionally why would you ever leave the protection of your vehicle, especially if you have a gun.
