I find that kind of sketchy too, but not as sketchy as the state withholding an aggravated assault with a firearm charge just so they have something to fall back on in case this trial goes bad. If he would have gotten a not guilty last night, then had to go through another trial for the same incident, I would have a problem with that. The state should lay all their cards out on the table from the beginning.

Or if Hayes hadn't smashed into the back of a vehicle? Let's remember there were more parties at fault here than just Hernandez and Smith.

I've ran into the back of someone and it's happened to me twice. Amazingly, no one was shot or killed and there wasn't even a confrontation .

That says a lot. Not one person on the jury thought it was self defense.

Where all are the self defense posters that were on here last week saying Hayes feared for his life and acted in self defense?

Good job on not doing what Hayes did.

The victim blaming (not by you necessarily) now that the verdict has been decided on is absurd. Perhaps if Hernandez had been the one killed, I could understand it. But that's not what went down.

if I rennet right, he testified that he did not know he shot her. That's the only evidence regarding her shooting I recall at the moment.

Did you know that according to those here and an "expert" you did it intentionally because you didn't apply your brakes 30 seconds before impact?

I don't believe I ever said it was self defense. I was pretty indifferent on which way it went. However, I will continue to call bullshite on elements of the trial I believe to be.

Nothing in that last post of your was an element of the trial.

ETA: Or maybe I missed the testimony. Can you link me to where the expert said you had to hit the brakes 30 seconds prior to contact for the hit to not be intentional?
