This is about getting the right settlement out of court.
As a non- academic this is not as much legal as it is policy. When you show a company does not follow its own policy that does not substantiate a legal standing that will demand reinstatement or damages.
You have to know the LSU Administration knew this would happen.
In the end if RK is smart he will take his settlement and walk away- it may not be just but it may be best
LSU could simply say- we revert back to policy and will pay you the one year.

I think they will give the year at a minimum.
Will he have a strong case for additional moneys for the breach of policy and how they handled it all? I think so.

I hope Roy gets every penny he sues for and then some.

Absolutely.
I wouldn't want my kid going into that mess right now. It is such a same. TGBFTL is a dream that a log of kids have to play in while they are in college. I'm 50 years old and I look at my years in the band as some of the best experiences of my life.

Federal court is much more streamlined than state court yes, they have a date set for everything. Federal court also has a mandatory settlement conference that all parties must attend to at least discuss a settlement.

IMHO, I think it was a mistake for LSU to name Roy director in the first place. TGBTL took a clear step back from what it used to be, under his direction. I don't mean that as a slight to Roy because I think his strengths lied in his interaction with the band members and in his capacity to support the band's direction--"Director of Bands" wasn't a good fit for him just as much as he might not have been a good fit for the position. The bands clearly needed to move in a different direction, but LSU painted themselves into this corner and clearly manufactured their "reasons" for dismissing him in a chickenshit way. They should've just owned the decision to move on, from the start.
Having some insight into LSU's inner workings, I'd add that the SOM is dysfunctional as frick, HRM are underhanded chickenshits in exactly the way that this is playing out (I'm aware of other dismissals that mirror this very, very similarly), and the whole university has problems of this manner on every scale.

Many people around the country would disagree. There are many college band directors who believe the Tiger Band sounds better than ever. Here is a short list of what has happened since Roy was named Director:
1. Roy was named "Band Director of the Year"
2. Tiger Band was named as one of the "Top Ten Marching Bands" in the USA
3. The Tiger Band has had two international performances (first in their history)
4. Numerous positive articles/accolades that benefit the University (do a google search)

The following is what I wrote in an earlier thread about similar complaints:
The scholarship money available for Tiger Band students was basically cut in half just about the time Roy took over the band, and they were no longer able to offer out-of-state tuition waivers. I guess a lot of this can be blamed on general money problems with higher ed in Louisiana. But there is no way such cuts would not have affected the quality of the band.
The students in the band bust their asses, and every time I have seen them, either in rehearsal or in game day situations, I've been impressed with their class and professionalism. And I say that as a former high school and university band director who has been around a LOT of big time programs in my time. But, again, if your scholarship funding is drastically cut, you're going to lose out on some really good players, and that's going to affect the quality.
Having said that, the quality of the LSU band is still very good in comparison with other SEC, ACC, and Big Ten bands I've been around. Is it the best? Probably not...but it's still in the upper echelon.

Ironically, Linda Moorhouse would've been the director if the SoM hadn't pulled the same kind of bureaucratic nonsense.

"That dude (F King) is such a worthless failure of a POS. He has given LSU the biggest negative bump in the media I've ever seen. His whole entire life consists of making himself known politically and whining about money. I mean, how many schools have been on ESPN with rumors of their tier 1 football teams shutting down (which is actually making it's own money and PAYS the school)?
The thing he doesn't tell anyone is that LSU's budget has been increasing every year for as long as I felt like looking back ('09 was where I stopped).

First off, I recognize that you took the tone of my post as being more harsh than it was intended. I've known a lot of TGBTL members and alums and the vast majority of them adore Roy, so I know full well that he's great. But I've also heard a lot of those alums say that neither the sound nor the marching has been as good since Wicks left. Those are huge shoes to fill, so the slide in form is not Roy's fault--anyone could've been hired and done a poorer job than Wicks. As a fan, though, I have been disappointed.
Answer this question: how many times has the band performed an Earth, Wind, and Fire halftime show? I'm serious. Has it been 6 times over the past 3 years? At least? My point is not to denigrate Roy nor the band, but that is simply not up to muster.
Again, my point was that Roy should've been kept in a position that he could've remained in, given his history and love of LSU. By putting him in the position of director, the only two ways out would've been retirement or dismissal, with retirement being the less likely long term outcome.

You know, everyone keeps mentioning the Latina flair and earth, wind, and fire... I remember sitting in that stadium before he was director (from 2002-2006) as a student and also having a Latin halftime show, and also have a Motown show that featured EW&F. How come no one gave Wicks a hard time about it? The disco one was also pretty boring and Wicks did that almost every year.

i would be very interested to see a comparison between a Wicks halftime (2009 or earlier) and a Roy halftime (2011-2015). I'll see if I can find videos, when I've got time to do it and am not on my cell phone.

None of those halftime shows pre-2009 were Wicks. Yes he was director of bands, but Moorhouse was responsible for all of the performances, choreography, drill, an musicality we performed over that time.
Roy was in charge on 1 show per year. Wicks was there for comedic relief

This thread is pretty hilarious. There is legal analysis of the state and federal law claims, some anecdotal stories related to individual defendants, and analysis of Neck and how much Earth Wind and Fire is played at halftime by the band. tRant

This thread is suffering a lot from "Back in my day" syndrome. I was in the band from 87-89 and we played the hell out of some Latin Flair. Malaguena was a staple. I bet I could still play it from memory now if I had to.
