Yep. If someone had drugs at work for recreational purposes and they were kept under lock and key in the employers drawer and another employee managed to steal those drugs and management found out, you can bet employee who brought the drugs to work would be in trouble too and probably fired. The fact that the student took the phone without permission has no bearing on the fact that the teacher brought pornography that was easily accessed to school.

I don't think we are very far off as far as opinions on this. Mine just teeters a little more the other way. If I was an attorney, I think I would take the schools side before I'd take hers. I could argue both, but think the school has a better shot at winning.

If I accidentally had something on my jump drive that someone accessed by stealing my jump drive then knowingly distributed my personal property off my personal property? I would feel slightly culpable but if I had a union job and was told on the spot I had to resign, I would definitely sue.
You said you'd feel slightly culpable, and all along I've said she have some responsibility for the pics getting out. I'd say that's closer to agreement than disagreement, no? I never said she should be fired, mainly that she's not completely innocent in all of this.

I could argue either way. I think I just would be on the other side beside the plantiff in this case. As stated before the civil precedent that could be set could very easily be transferred to a criminal preceding as justification by a halfway decent DA.

She could claim the nudes were personalized art. Someone being Nekkid isn't automatically porn. In short, her "art" was stolen.

I may be late to this German party, but I think the only way to clear the teachers name, is to post new nude photos of her. You know to clear to get it out on the open, so it won't be a big deal.

He should have kept his little baw paws off of it. Had he not taken someone else's property without permission there would be no issue. She has a reasonable expectation of privacy. What else is she not allowed to have in case a little electronics thug digs through her stuff?
Condoms? Tampons? Kleenex? Chapstick?
If you think what he did was OK then you are probably one that eats others lunches out of the office fridge. You will soon jack a car.
