I just know that when she was going through this, we did a lot of research on it and it was unanimous that people rarely get forced to leave their jobs over non-competes right to work states. The exceptions would be companies who have iron-clad ones (many small ones don't) and people who are higher-level and can really frick up the previous company. The internet has been wrong before, so it may not be true, but I find it hard to believe the law is coming down on random non-essential employees staying in their field.

In the case of my friend, she was in fricking print advertising sales. I highly doubt any judge would force her out of a job selling freaking advertisements for a local magazine And like I said, was not at all worth the company fighting over. There wasn't nearly enough evidence to support her job change being "competition" either (she moved from an oil/gas/industry magazine.. to a local lifestlye magazine).

LOL so false.

had an employment offer fall apart 3 months ago because the president of the company did not want to deal with the possibility of someone coming after them and me because of my non compete. I'm not even close to an executive. Sucks because it would have been a sweet 18% per year base + bonuses raise.

You can still be forced out of your job if the new job isn't really competition but the old job views them as that? That makes no sense. And sucks.

Glad I don't have a non-compete

Question (since internet apparently is wrong sometimes and I am curious): Are employers in LA required to pay you out for accrued vacation when you give a proper notice and leave? Everything I read says employers in our state are required to do this, but then people I talk to IRL tell me about XYZ job that didn't pay them for accrued vacation when they left.

Point being, have your lawyer review it before you sign it.

Especially if you're in sales.

First thing we ask for when interviewing sales is a copy of their non compete. Turn that over to attorney and he lets us know if it's worth continuing with candidate

Wish they would have done that for me. Would have saved me a lot of time and excitement.

Told them I had a non compete up front. The hiring manager wasn't concerned. We spoke about compensation and everything was in writing. A week went by and I asked about where we were. "sorry , your non compete has been deemed a risk we aren't willing to take" - later dick.

Welp, back to my job. Luckily in a year and a half, my non compete is null because I had my lawyer redline it before I signed it. Also only in effect if I leave voluntarily. If they fire me or lay me off, I am scott free.

Friends. The CEO/President of the company was/is unanimously hated by all employees there, so it wasn't difficult. It turned out that her non-compete was one from before they updated them as well, so it was only valid for 90 days after she left.

5 (out of only 12) employees left after the friend and myself, now that I think about it. One went to work for a client. No idea if that was covered in the non-compete, but the company was thrilled for her.. I guess because they figured her employment there would guarantee that company remains a big-paying client.

WTF? I didn't say that's what I think. I don't think anything... as I never have (and hopefully never will) deal[t] with a non-compete. I just said that is what I read.

Also, there is nothing insulting about calling 6 years younger than I am. If I had that body still, I'd be happy as a clam.
