we keep personnel files locked and have cameras though so they'd have to be stupid to take it

I think up until several years ago that was the general consensus of NCs in LA, that they were almost unenforceable, but as the companies learned and evolved and began drafting them more narrowly tailored in scope and with more detail they've gradually been enforced more and more by the courts in LA.

I think there's still a presumption against them but one that is easily overcome by reasonable limits of time, region and process.

Yes I believe so. In fact, I think a fulfilled notice is unnecessary in Louisiana. More often than not, people just have no clue how their accrual process actually works. Could also just be an oversight in smaller scale Payroll departments - they're not exactly rocket surgeons.

That's fine, I'd expect nothing less. I stated earlier, I'm quite confident that the company he works for, being as small as he describes, won't be able to prove jack scratch.

I just found the story hilarious on a few different fronts.

Was hoping for better stories than stealing non-competes.

I don't really know what else you'd have a desire to steal beyond a write-up or a non-compete

Sorry. No. I have enforced non-competes through litigation many, many times on behalf of several companies. It is true that most small companies won't pay to go that route but many mid-large companies will successfully.

As for the OP, the company would likely get in more trouble legally for keeping confidential files with employment information unsecured than the employee would for robbing his file.

Sounds like you should have told the offering company you needing two weeks to get fired.

Go back to your present job and tell the boss to F off.

When a promotion comes up in this office, I peruse the local HR person's folder and pull all of the questions.

She doesn't realize anyone can access her files because she doesn't keep them password protected.

I'm batting .750 in the interviews so far.

The position I didn't get is being cut anyways.

The general rule is yes, it is owed to the employee if it has indeed been earned.

There may be exceptions if the employee waives his right to compensation in this particular situation as terms of hire, but what legitimate company would ask a new hire to sign that?

Vacation is not a federally protected right of employment, meaning a company doesn't have to offer it. Same with sick days, although Obama is trying to get that changed, which of course he won't succeed because republicans own Congress.

Oh and another thing.

Proper notice is not a requirement to receive vacation pay earned, again unless you signed something to the contrary as a condition of hire.

Yep, I've pressed charges on a employee that we busted.

I entertained that for a quick second. However, in the business I'm in, everyone knows everyone and my rep would have been trashed. Also entertained "tanking" until I got fired if I got it in writing that the new company would hire whenever that happened, but would they want to hire a guy who would willingly get fired to get a raise?

Contrary to my post history, I have morals and integrity. Ultimately I chose to stick with the company I am with and not find a way out of the non compete. I still make good money and I am with a company that likes me enough to not lay me off.

I was stating than you can write a non-compete to prevent former employees from going to work for a competitor, notwithstanding a win or loss on a specific contract.

I wasn't speaking to your specific contract since I obviously don't know all the details, which is why I quoted that specific part of your post.

Let me give you a little more wisdom:

Using your admin privileges to hack into a meeting to steal and share confidential information certainly violates any employment agreement your "friend" signed and is illegal.

Your "friend" sounds like a loser who should be terminated and prosecuted. You spreading the story on a website full of IT contractors is pretty dumb, too.

How'd like you like that wisdom, sport?

I was working late one day and the secretary came into the programmers work area and got into a verbal altercation with another programmer. It went on forever and got really heated.

I called the programmer by dialing an outside line and then his extension. It rang as an outside call and he had to answer it.

I told him things were getting out of hand. I also said I had work to do and had to hang up. I told him to hold the phone to his ear and keep talking until the secretary left.

That worked. She eventually walked off. He said if it came down to a highly skilled programmer and a secretary, she would get fired first. I suggested she knew where the bodies were buried and they may be afraid to fire her....
