I wouldn't. We actually played like that.
Then you're a dumbass whose parents should have raised better. If at any age, you felt going through a park aiming at people with what looks to be a real gun, then pulling it on policemen, you have terrible parent(s) and are just generally stupid/mentally handicapped.

He was a 12 year old kid playing with a toy gun, we all did that as kids. Your comment is sickening.
I never removed the markings from a toy gun then pointed it at random strangers in an area known for drugs and crime.
If that's "playing" to you then you probably had a messed up childhood.
Now did we play in the woods with other kids and have BB gun and Paintball wars? Yes. I learned a lesson the hard way about that.
But you sure as hell don't point guns that look real at innocent folks in a public park. That's the definition of the stupid game.

no he's not
Correct. I shouldn't have used the present tense...he's dead. But yes, he pulled the gun from his waistband. Read the fricking article.
quote:
There was no possible way he did not put that car too close to the kid.
I didn't say that he didn't put the car too close to the kid. I said that you guys were assuming they meant to do that. They have to know that's the guy they're looking for to "put the car too close to him" (intentional act). How do you know they didn't drive up on him, NOT REALIZING he was "the guy" (the gun was in his waistband and they were looking for someone actively pointing a gun at people) until the very last second? You do see the difference, don't you? If not, you should castrate yourself so your genetics aren't passed on.
quote:
You try doing what they did under the same pretenses and see if criminal charges are filed against you.
Criminal charges wouldn't be filed against me or anyone else. Not under those circumstances. Dude walks up to me, pulls a fake gun from his waistband, and I shoot him? Not goddamn thing happens to me because I acted reasonably, given the circumstances and information I had at the time. You know hindsight isn't allowed, legally, when making the decision on whether someone's actions were reasonable, right?

1. Police officers arrive on the scene unaware that the "weapon" is fake.
2. Officers tell kid to put his hands up.
3. Kid reaches for gun and points at officers.
4. Gun does not have the orange safety feature on it to show it is indeed a toy.
I'm not entirely sure how this can be construed as murder.
Say what you want about his age, but 12 years old is certainly old enough to know that when a police officer tells you to put your hands up, you do it. At the least you're old enough to know NOT to point a gun (toy or real) at a police officer. It's not like he was a toddler.
It's a tragedy that a young child is now dead, but considering the circumstances above, there is no reason to bring murder charges.
Does anyone here think they just arrived on the scene and thought "Hey, I feel like shooting a child. Let's do it."?

frick off, smart arse. The video does not show him "pulling the gun from his waistband".

I'm not saying the kid wasn't behaving like an idiot, because he was, but the callous comments on here regarding the unjust death of a 12 year old kid are disheartening.

Maybe 1.8 seconds elapsed in this entire portion of the incident.

What I think is that this a-hole was known to be dangerously incompetent and was still put out on the streets. City/county/whatever have a massive lawsuit coming and I hope they lose.

I don't care to join in, but if someone goes out looting, can you get me a nice smart tv? Nothing big, maybe about 40" for my shop.
I'll take a PS4. I don't have time to play very often so I don't want to pay full price. But it would still be cool to have.
No justice no peace!

I'm not as extreme as I started this off with. I did that as an attention getter. It worked.
I've covered my real thoughts and others have brought out some pertinent facts. My real thoughts are that the situation was poorly handled and at least some sort of charges should be placed on one or both of these officers.
FWIW I just heard a professional with credentials at or above FBI say the same thing.

Are you fricking blind? Granted, the video quality sucks (that works against either assertion), but you can clearly see his hands go to his waistband right before he is shot and falls.

I'm not sure what charges are applicable here. = ignorance

The comical part is it will be paid for through tax dollars.

Is it your contention he just felt like shooting a child, so he did?
You act like he goes hunting for children or something.
I'm not going to give an officer a pass because he's an officer nor am I going to side with the child just because it's a child.
It's an unfortunate situation that I hope none of us find ourselves in. Both having to decide whether or not lethal force is needed to defend my/our lives or having a loved one killed by law enforcement.

I would definitely argue that there is a moral issue with how this was handled but nothing illegal happened. That makes it even more hard to deal with.

So when I was running around my neighborhood as a kid with toy guns playing army with my friends, I could have been shot by a cop and people would have justified it? Good to know.
Did you not know to not have realistic looking guns?
Did your parents not care enough to ensure that you weren't running around looking in peoples windows with what looked like an actual gun?
Did you not realize if the police see someone with what looks to be a real gun they may react?
How do you act like this is some sort of surprise?

Yes
I would have lit his arse up too.
when you read toy/replica I bet most think of this.
The fricking media should show the replica gun photo on all these articles and in the news broadcasts.

Did this really happen? The video is poor but not much time transpired between car stop and shooting.
