Yet he doesn't actually escape until after he was presumably dead.
Now he may have been planning to escape; however, it's disingenuous to justify the actions of shooting because of the felony, when the so called felony didn't occur until after he was dead.
So if the officer had gotten a 2nd shot off AFTER he killed the guy and the dead guy evaded... that shot would have been justified.
I think I got it now.

I just don't see how this raises to the level of murder, when the cop that shot the young teacher fleeing a field party a year or two ago walked. Those are very similar cases. Did her attempting to flee show just cause for point blank execution without due process?

Just watched the video and wow just wow. The guy looked drunk and driving without a license on him but he was complying with the officer's commands and there was zero justification for the cop to shoot him. The defense attorney would have to do a slam dunk job to convince me that was not murder after seeing that video.
Just another example of why cops should always wear a body cam. Body cameras have protected multiple innocent cops and the body cam got this arsehat indicted and hopefully convicted.
And the cops lied in their report. Sheesh.
I didn't even get to that because I cut the CNN link off after the body cam video was through. I don't need to hear CNN's race baiting spin on the issue to see that was an unjustified killing.

If you're driving away from someone, anyone has the right to blow your head off. This is America. I really don't see the argument here.

The guy wasn't under arrest. You don't have to always listen to an officers command. Some people actually know the law. If a cop says let me search your car...you can say no, they don't have the right to open your door and yank you out. If a cop ask to come in your home, you can say NO. Those instances are not following command of a LEO.
In this case the officer had the right to get him out of the car, that is the only thing about his actions I would defend.
This guy should have never been a police officer.

So what about when an officer pulls you over for a routine traffic stop and asks you to step out of the vehicle? Can he just say no?

Oh it's a real thing and it was around long before police used it. Hell, I have heard sports coaches talk about it.
Which is why they teach it in the Police Academy and warn about it. Doesn't in any way, shape or form absolve the guy of responsibility for his frick up. Just explains it. But you also want to call me a boot licker so frick off as well.
This is what happens when you try to reason with a bunch of people who just want to internet scream at each other. Go join the Mayor, Prosecutor and Community Activists if you want. They all agree that they should just hang the guy without bothering to figure the shite out.

What other jobs require you to make split second decisions that if you choose wrong could send yourself to jail for the rest of your life?
Doctors, nurses, EMT's, firefighters, some engineers...
There are plenty of professions that make life saving decisions every day. The only ones that are 99% of the time immune to prosecution are the ADA's and police. I don't see a compelling reason why they are the exception to the rule.

I don't see justification for the shooting, even with Meauxjeaux2's felony argument.

It can still be murder without the intent to kill. It just isn't premeditated murder. Even if it wasn't murder, it wouldn't be neglient homicide which is a misdmeanor under Ohio law, it would be reckless homicide which is a felony under Ohio law. LINK
THAT is some excellent input as I will readily admit I was applying my knowledge of LA and Federal Statutes to this situation. Absolutely agree this is a felony act.
You better get the frick out of here with that logic shite. Not appreciated in this thread...
Thanks for your post.

he was because of his own actions, causing the LOE to make a mistake and use excessive force. However, it all began with the guy not obeying the officer.
I Bet in other threads you complain about people making excuses and preach personal responsibility.
the LEO is a big boy and made mistakes all on his own.

As is (was) the deceased, whose family will undoubtedly be oblivious to the fact that if he had followed instructions he'd still be alive.

Mark my words, the Prosecutor, Mayor et al will frick this up like they always do and overcharge this guy as if he set out to kill this guy before he ever stopped him. The Officer will get acquitted because he was overcharged and then the city will burn.
No way they let this guy walk and risk riots. Plus, the video is pretty damning to at least get this guy on negligent homicide like you said.

The murder charge should help prevent protests. Nobody in this world expects all cops to be perfect. We give People of low intelligence (on average) a lot of power and a gun, these types of things will happen, nobody is perfect. As long as the bad ones are prosecuted this is all anyone expects.

He was a corpse at that point. You want to charge my grandparents for littering the cemetery too?

You must exit the vehicle if requested to do so by police. This is firm case law from the SCOTUS. He also had an open container, which is grounds for arrest. So yes he was well within his rights to order him out of the car on multiple levels.

I really love that school is starting. Now I can get back to indoctrinating the kids of these excuse-making libs and teach them to respect the law (and other authority).
Here come the down votes and the bashing of public education...
