What's the proper etiquette here?

So we are looking into/about to have our driveway paved where it had previously been gravel. We did this to give our kids a place to ride bikes/scooters/play basketball/sidewalk chalk etc...
There is an old large tree in our neighbors yard and a lot of the branches extend out over our driveway. Not too infrequently decent size pieces of the branches will fall onto our property which obviously could pose a hazard to children playing.
If I wanted to have some of the limbs cut down am I allowed to do that or do I have to have permission since the tree is on the neighbors property?
Would asking them to split the cost or make some sort of arrangement be a reasonable request since many of the branches are dead?
What would the OT do in this situation?

On the property line. From the ground, straight up into the sky, that's your property. You can shave off an entire side if it encroaches on your property. Legally.

I would consult with the neighbor. He's probably aware of the problem, and if he's a decent person would probably split the cost with you.

you have the right to cut whatever is hanging onto your property.
that said, if you want a decent relationship with your neighbor you should at least notify him of your intent and the reasons.

this. But as a courtesy, I'd speak to the neighbor first and let him know your intentions. In the end, you're going to do what you want to, so no reason to appear an a-hole about it.
However, think long about getting rid of the shade that tree provides. You may regret not having it in the future. Especially if pruning the tree ends up harming it.

if there is obviously dead branches remove them but tell the neighbor
i have a better idea build a padded room inside where they won't get hurt and sunburned, and no one can drive by and yell mean things at them..

Why did you need to include the driveway info? I didn't need that to tell you to talk to your neighbor and then go cut the branches

Talk to neighbor first as a matter of courtesy but you can cut anything over your property.
And for those complaining about pussification of America, please feel free to drop a dead limb on your unsuspecting child at your leisure.

Difference In the old days and now.
In the 80s the kids would be climbing the tree siting on the branches. Today parents want to cut the tree up in the one in million their mistake happens to be under it on their iPhone when it sheds a branch.

First off, I'd leave the tree limbs - they'll provide good shade, but if it's an old dilapidated tree and is a legitimate danger the best thing to do is to talk to your neighbor.
If you want it removed, offer to cover the entire cost.
As some of the previous posters have noted, it is you property from the line clear up, which means it is also your cost to upkeep that line.

Approach your neighbor with the idea of splitting the cost of having a tree surgeon come in to remove the dead limbs and properly prune the rest.
