no, they'll take his statement the same as if it were at the scene.

They will if he pushes but it will not be a full accident report since he left the scene and did not report it immediately.

He could also be cited for leaving the scene of an accident and not immediately reporting it.

I fully understand that but it's better than his current plan.

I don't need to make anything up. It's the law. I don't see why you think it is so far fetched.

The individual officer that takes the report has the discretion on whether to issue a citation. So it purely depends on if the officer felt like giving him a ticket.

In the future, use your phone to take pictures of both cars and licens plates and location, aswell as the other driver. It might be weird, but it can be proof in court. Videos even better.

don't know about collecting from him or the insurance company. but if you're planning on trading the car in soon you will not get what you pay to replace the bumper back on a trade in. fyi.

Some guy ran into my wife's car a couple of blocks away from my house. I went down there and this guy was telling me he just got out of prison and is on probation, didn't have insurance or registration, and he was just test driving the car. He said he worked at a body shop and would fix it. I said I wasn't interested and called the cops and they wrote him up and impounded his car. I could tell the guy was a POS. Saw his name in the arrest reports last year for breaking into cars.

I also got rear-ended a few months ago by a teenage girl, and could tell they had money, so I took a buch of pictures, got her info, and talked to her parents on the phone at the scene. Also had her text me a summary of what happened in case it came back to bite me. Got an estimate and her dad cut me a check with no issues.

You're always taking a chance by not calling the police, but sometimes it works out.

My mother bumped someone in traffic. No damage to her car, minimal to the other car. The lady that was hit didn't want the police called so my mom thought she'd just pay to fix the bumper....$1000 estimate.

Two months later we are informed that the piece of shite worthless trash woman is suing the insurance company for pain and suffering.

Moral of the story....call the cops.

Had a similar situation happen to me. You'll most likely have to file a police report for the insurance company to treat this as an uninsured motorist situation. Don't know how this works in Louisiana, but you can actually do it online in Texas so I really doubt you will have a problem.

Long story short some idiot rear ended me in a wal mart parking lot. i didn't call the cops, just got the information. We filed the claim with our insurance company and eventually won the claim without ever filing a police report.

I know that's a little different because she had insurance, but it can be done.

I'll just tell everyone here what the attorney told us. Call the police no matter what. The road is full of con men looking to rip off the system.

I had a female driver rear end my brand new Tacoma couple years ago. Luckily for me I didn't have to call the cops to get a police report...cop was two lanes over and saw the whole thing. ..and the count hair driver still had the nerve to lie.

If you're afraid of this guy, don't pursue it. I find it very hard to believe that he would seek retribution against you if you filed charges on this deal for non-payment.
