Auto insurance claims question

I have thankfully not had to deal with an auto insurance claim in almost 18 years. But last week one of my kids was hit while driving a car I own. No injuries but car is damaged and not currently driveable. Cops issued other driver a ticket for unsafe operation, other driver is a minor.

Other driver has progressive, we filed claim through them. Week later they are “still investigating”. Apparently from talking to their adjuster, they have yet to make contact with their driver, despite several attempts. They have spoken to their parents of the other driver.

Police report should be ready today, going to get a copy and send to adjuster,

Did we screw up by going through other driver insurance? Should we have gone thorough our insurance Geico? We do have comp and collision on car.

Had the same issue. All worked out just took a little longer. But the lady who hit me was a junkie

Go through your own insurance to handle it.

Progressive, or any insurer for that matter, will not pay a dime until speaking with their own driver. If you need a rental and/or other benefits, go ahead and claim through your own insurer and pay your collision deductible. You're required to report the accident to your own insurer anyway, regardless of fault. They'll subrogate against Progressive to try to get your deductible back.

You did the right thing. Wait for their insurance, they will pay assuming the person that hit your car had adequate coverage.

Just takes a little bit longer because insurance companies suck.

Yes/no, they won't proceed any further until they have the police report showing them fully liable. Going through your insurance may have sped up the process, but once you have the report showing them as liable things should speed up a bit.

Source: Currently dealing with the same shite after being hit by a drunk with no license and questionable immigration status, luckily the bastard had insurance. However, they wouldn't proceed any further until we had the police report despite providing them with dashcam video of the whole accident. It'll be a month on Sunday and I still have no idea if they'll be fixing our vehicle or totaling it

You pay for your own insurance, you’re their customer, not the other one (unless you both happen to have Progressive).

It’s way easier to just file through your insurance, get the ball rolling, get your shite back then have the insurance companies battle it out and get your deductible back.

No you didn’t because you still have the availability to file thru your own insurer.

Personally, I’d file through both in case this situation occurred. My company would be ready to step in and cut a repair check immediately after inspecting my car rather than having to wait on liability.

You pay for collision coverage so it’s there for you to use. You may be out your deductible but that should be reimbursed by progressive or by your insure when they collect from Progressive.

Others will have varying opinions, but a not at fault accident shouldn’t cause you any problems. In theory your company would get their money back from the other insurer and you’re using average you’ve already paid premium for.

As long as the PR clearly lists Progressive’s insured at fault then you are good. Will speed up the process on Progressive’s end and it won’t matter if their insured contacts them or not.

This is the advice I give to my clients. This is not legal advice to you as your situation may differ. Waiting on the adverse carrier always results in more delays and frustration. You pay for collision--use it.

But Mr. Motorboat, won't my rate increase? not if you are not at fault.

Always go through your insurance company. Your claim is against your policy, not the other driver. You will get the car paid for or repaired in good time. Most people think that by not going through your insurance company, the claim somehow will not be reported to your insurance company and your rates won't go up. Wrong. As soon as the accident is a public record - the police report- your insurance company will know. If you make a claim directly against the other driver's company, there is really nothing compelling them to move fast on paying you.

Short answer is kinda.

First, you almost certainly have a contractual obligation to timely report any accident to your insurance company. While it is very unlikely that the failure could result in denial of the claim or cancellation of the policy. That is very rare and usually has accompanying reasons.

Second, always make the claim with your insurance company; it isn't like they are not going to find out about it. Using your insurance company is almost always the quickest/frictionless way to get your car fixed. The negative is that the other company hasn't taken the responsibility when the car is fixed, you may have to front the deductible until the subrogation is finished. One positive is that if you have rental coverage, if you don't need a rental you can get that payment as loss of use.

Note this is a generic insurance procedure/law, it is possible your state or contract is different. That said it is almost certainly the case you have a contractual obligation to inform your insurance company of the accident.

I wouldn't involve your carrier.

Progressive won't do shite until liability is proven in report and then accepted.

I hope your child's neck and back injuries get better in time with treatment.

well sir, they aren't surcharging you for your accident but you did lose all your claims free discounts. Sorry about your luck bro.

If you are a good customer, file on your insurance.

If you or other drivers on your policy have multiple speeding tickets and accidents, then I would attempt to file on the other policy if possible (if possible is the key wording. If you need a car asap, it may not be a good option).

In georgia if you have several non-favorable incidents, a not at fault claim could tip the scale and result in a cancelation/nonrenewal.

I'm surprised to hear they were issued a ticket. I've been in a few wrecks due to other people's negligence in my 45 years and none of them ever got a ticket.
