Captain and first mate of the US-seized oil tanker Marinera have been moved onto a US Coast Guard vessel outside UK waters

Interim interdict preventing their removal from Scotland was lifted after the men were no longer in Scottish jurisdiction

Lawyers for Captain Avtandil Kalandadze’s wife alleged he was being unlawfully detained and that the US was bypassing extradition rules

Tanker was seized earlier this month over alleged breaches of US economic sanctions involving Venezuela, Russia and Iran

Remaining 26 crew members were processed in Inverness; five opted to travel to the US voluntarily, while 21 will depart Scotland for other destinations
The captain and first mate of an oil tanker seized by US forces are no longer in Scottish waters, a court has heard.

Judge Lord Young passed an interim interdict on Monday evening, which prevented UK and Scottish authorities from removing Captain Avtandil Kalandadze from Scotland pending further court proceedings.

Lawyers instructed by his wife, Natia, alleged that the Georgian citizen may be being unlawfully detained without charge. She asked them to raise an action in the Court of Session, Scotland’s highest civil court.

Mr Kalandadze was on board the Marinera when it was seized by the US in the North Atlantic earlier this month. The United States has accused the vessel of breaching economic sanctions by carrying oil for Venezuela, Russia and Iran.

The ship, previously known as Bella 1, was boarded south of Iceland and is now in the Moray Firth.

Legal papers lodged in the case state that Mrs Kalandadze is concerned about her husband’s safety.

Her lawyers argued that the US government was attempting to bypass established extradition processes to take him to America, and that this would breach his human rights.

However, during a hearing held by Lord Young on Tuesday morning, it was revealed that both Mr Kalandadze and his first mate were on board the US Coast Guard vessel, outside UK waters.

The remaining 26 crew members were taken to the Army Reserve base in Inverness for processing and stayed the night at the Premier Inn in Elgin.

Five have elected to voluntarily travel to the US, whilst the other 21 will leave Scotland for other countries.

Lord Young recalled the interim interdict issued last night after the 26 crew members had decided to leave Scotland and the captain and first mate had been taken out of Scottish waters.

BREAKING: Scottish officials say two people were taken from Scotland in the middle of the night by the U.S. military, despite a direct order from Scotland’s highest court that they remain in the country.

Now Scotland’s Greens are calling for real consequences; including evicting U.S. troops from the base at publicly owned Prestwick Airport.

This is a sovereignty breach and allies are starting to say it out loud.

I didn't think Scotland had its own military since 1707.

A Scottish lawmaker railed against US President Donald Trump on Wednesday over the American military’s seizure of an oil tanker and detention of its two top officers earlier this month in waters between Iceland and Scotland.

Ross Greer, a member of the Scottish Parliament and co-leader of Scotland’s Green Party, said that two people—tanker captain Avtandil Kalandadze and his unnamed first officer—“have been abducted from Scotland in the middle of the night by the US military, despite our highest court ordering they be kept under our jurisdiction.”

As the Scottish newspaper The National reported Thursday, Kalandadze—a Georgian national—and his first officer were taken out of UK territory by the US Coast Guard earlier this week despite a court ruling against their removal from Scotland’s jurisdiction.

“He’s not our ally. He is a fascist,” Greer said of Trump during his remarks in Parliament on Wednesday. “Our sovereignty has been violated, our courts have been defied, and a foreign military has abducted two people from our territory.”

Greer called on the Scottish government to immediately evict US troops from Prestwick Airport, which is used by American forces.

“Will the first minister show Trump that his piracy has consequences?” Greer asked.

The BBC reported Wednesday that the Trump administration “says it intends to prosecute” Kalandadze and his colleague for alleged involvement in the violation of US sanctions.

Angela Constance, Scotland’s justice secretary, has said the Trump administration’s handling of the vessel seizure and abduction of its crew has demonstrated a lack of respect for Scottish jurisdiction.

“We have a number of questions, we have a number of concerns, and deep frustrations about how this matter has evolved, because it is a matter of significant public interest and confidence,” Constance said earlier this week. “The Scottish government wants to play our part in international justice because that is appropriate and responsible. But that starts with the recognition and respect that must be afforded to Scottish jurisdiction and Scots law.”

Aamer Anwar, an attorney representing Kalandadze’s wife in a lawsuit over the incident, said earlier this week that the captain was “whisked away under the cover of darkness” by US forces, and “we have no idea what role our own governments played in that.”

“A dangerous precedent has been set, as the US should not have the power to arrest people under our control,” said Anwar. “These people have been denied their most basic human rights right under our noses, whilst the UK knowingly assisted the US ‘abduction’ of two men from Scotland to avoid the Judicial Review taking place.”

I love how this dude was shot down during the hearings, very politely. The chairman guy was like, "well, there just isn't much we can do about this. But we will consider your request to eject the Americans from our base."

I like our new approach to all of these European leeches. They can’t lift a finger to invest in their own security so Trump says fine, well do whatever is in our interests. Whats Scotland gonna do? Sanction us with their army?

Sorry, Scotland. We only care about relevant countries.

Also, if the US military was able to snatch him without Scottish authorities knowing, then he clearly wasn't being held in a facility by government officials. If you want these foreigners to stay on your soil, then do a better job of housing them securely.

Don't blame us because you're incompetent.
