Suspect arrested, victim released from hospital.
And of course 7-11 fires her for violating policy.

I wonder if that’s a franchise owned store or company owned. They are HQd in Dallas and I know some of the management - doesn’t seem like a policy they’d back.

Usually they tell you not to engage a shoplifter so they don't end up getting a workers comp claim or a lawsuit from the perp.
But when the perp escalates to violence on his own all bets are off. I hope she owns 7-11.

For bringing a gun to work, but I don’t see how you can work at a place like that today and not be armed.
quote:
"He threatened me, and said he was gonna slice my head off, and that's when I tried to call the police. He started throwing things at me, came behind the counter. I tried to run off, but he grabbed his hands around my neck, and pushed me out of the counter space, and that's when I pulled out my gun and I shot him."
Police confirmed that Dilyard is protected under Oklahoma's self-defense law.
However, she was terminated by 7-Eleven on Monday for using her own gun. "They said that they were going to separate from employment because of a violation of policy," Dilyard said.
Also, the perp FAFO and had to call 911 himself to get help.
quote:
The suspect, identified as 59-year-old Kenneth Thompson, fled to MacArthur Blvd. and Northwest 34th St. and called 911.

I understand the policy but you have to wonder how stupid 7-11 is to fire her like this. You know it's going to get tremendous backlash. $20,000 check, a release of liability and a NDA was the way to go here. Are they stupid?

Yeah, they could have agreed she would say she just doesn't feel comfortable working there after the incident, which is almost certainly true and they understand.
There is usually a win to be had by a company with smart PR.

Meh, she was packing her own firearm. I imagine they have policy against it.
She can sue them for not having sufficient protections for her working space.

I'd wager it's likely an insurance requirement by their insurer.

7-11: Hey, we don't allow our clerks to protect themselves. Come on in and rob & kill!

Without her gun it would have been her family suing.

Statistically, being a convenience store clerk is a dangerous job.
OSHA can regulate grounded electrical outlets but cannot create a rule about a convenience store clerk working alone at night (particularly overnight)? If you are working alone (particularly female) and customers still have access to go inside the store, you are inviting an assault, robbery or worse.
In Texas (where the workers compensation bar against suing your employer doesn't apply if you are killed), you would have a nice punitive damages claim against a convenience store having your work overnight alone (assuming the store was not in an area with a lot of other activity).

Sounds like a hostile work environment to me, and it sounds like retaliation for taking reasonable action to prevent herself from harm in her hostile work environment.
I hope she gets a symbolic $711,911 out of this.

She started a GoFundMe and only asking for less than $3k, while she finds another job.
