Lawsuit against the State of Louisiana is a brilliant move by CBK and his attorneys

CBK's lawsuit against the State of Louisiana, and not LSU, is going to force LSU to pay a much larger buyout. LSU officials have stated numerous times that not one penny of taxpayer money has ever been used to buyout a coach and never will. Well, this lawsuit could change all that.
By filing a lawsuit against the State of Louisiana, the buyout, should CBK win, will be paid with taxpayer money, not booster money. LSU has two options. They could decide to fight this lawsuit, which will cost the taxpayers a lot of money, and run the risk of losing and it becoming a PR nightmare for LSU. Or they could go with the second option and renegotiate a buyout at a dollar amount both parties can agree on, which will avoid using taxpayer money and will allow both parties to move on. The longer this circus carries on, the worse it looks for LSU.

Or they can just pay what is owed over the next 6 years and force Kelly to actively seek employment, then have payments reduced if he gets a job.

If Kelly wins the lawsuit, he has to get the legislature to appropriate the funds to pay his buyout. He'll be added to the long list of appropriations that already exists. In other words, if it comes down to this, he'll never see his money.
This is all just a game of negotiations that will get settled eventually.

His lawsuit is against the Board of Supervisors of Louisiana State University.
That’s because his contract is also with the Board of Supervisors of Louisiana State University.
There is no 4D chess going on here with “filing against the state.” He simply filed the lawsuit against the counterparty to his contract. Him winning a lawsuit against the BOS would just mean they have to pay him his buyout per the contract.. it doesn’t change the party responsible for paying it.

he only had standing to sue one party. That party was the BOS, who happens to be a state entity. His contract was with the BOS, not the University, so that's who he sued

It can be dismissed if there is no cause of action from an actual dispute. if LSU is still paying Kelly and in negotiations where is the dispute?

I disagree. By suing the state Kelly would not see any money for a long time…if ever.
