Yahoo sports????

Unfortunately, this hit piece is also published on USA Today.
quote:

there’s nothing to dismiss in a declaratory judgment lawsuit

It can be dismissed if there is no cause of action from an actual dispute. if LSU is still paying Kelly and in negotiations where is the dispute?
The guy who wrote that got some facts wrong
quote:

We have no leverage

If we have proof of cause, that’s our leverage. I’m interpreting this lawsuit as Kelly’s attorneys attempt to reduce his downside.
or the case gets dismissed & Kelly loses his leverage & this backfires on him.
When Kelly said he was keeping receipts, I think he meant for his expense reports. LOL
quote:

LSU is doing some shady shite.

What specifically has LSU done that is shady?
quote:

There is no case here

I’m reading that the case is to determine whether it’s for cause or not. I think ultimately both sides agree on a reduced payout. It seems like it’s in everyone’s best interest to resolve this sooner vs later.

The article is misleading in the below quote on timing of first bye week. Technically the Vanderbilt game did occur “after” the 1st bye week, but the South Carolina victory on October 11th was the first game after that bye week with the Vanderbilt game taking place on the following Saturday the 18th.

I agree with your timeline... we had bye weeks after Ole Miss and TX A&M. the bye week in question had to happen between Ole Miss and South Carolina. I'm not surprised that the media stated it incorrectly.
quote:

Some causes are inherently incurable, which is acknowledged in the contract. If he was at odds with Woodward and unreasonably defiant, how could he cure it?

it was reported that Kelly left BTR for Florida during the bye week. That never happened even during the Hallman/Dinardo days.

https://saturdayblitz.com/brian-kelly-s-beach-vacation-during-the-bye-week-should-ve-been-the-final-straw
Assuming Woodward didn't approve this vacation in the middle of the season, this isn't curable. Looks like Kelly's attorneys and LSU are playing a high stakes game of chicken.
quote:

And I read this a little differently. It’s not a 7 day notice period, it’s a cure period for the employee to provide a response from Kelly. He has the right, but not obligation to defend his position.

I read that portion the same.

quote:

I think there’s probably a number between the $30 million LSU offered and the $45ish million NPV that Kelly would agree to. But this lawsuit is basically cutting through the strong-arm tactics and forcing LSU to shite or get off the pot. Either prove you can fire him with cause or stop bluffing.

I agree with this too. Who has more to lose? Kelly or LSU? I think ultimately this gets settled. it's in the interest of both parties for this to go away.
The original contract… he would get paid out over time. We get to subtract out from our monthly payout any income he makes from another job.

My understanding is we were offering a lump sum 1x payment. So, a bigger $ now or over the length of the contract less whatever he’s making.
LSU would have his credit card receipts.

He was always talking about receipts.

With as bad as our OL is this season, our only shot is with a mobile QB.
quote:

Lot of bad takes in these threads of people white knighting for BK. Funny to go back and read.

Going back in time... Les Miles and Ed Orgeron won titles here. I would have "thought" back then that Kelly would have just as good of a chance as his predecessors....

what i didn't know at the time....
that his special teams would not be special
that he would not focus on winning the LOS on both sides of the ball
that he would be so "absentee" from his own program that he claimed he wanted to win a national title

these were unknowns upon his hiring. and being bama in year 1 was another red herring.

It’s one game against a bad team but I like what I see, much more talented, more size, shooting and athleticism. We rarely imposed our will on anybody the last three seasons.

Last night was a nice win. However, in year 1 under McMahon, LSU started 11-1, then beat Arkansas going to 12-1, and ended the season 2-15. Last year, started 11-2 and then went 3-15 in conference.

McMahon's teams look great in November and December against lower competition, but aren't competitive in the SEC. Maybe this year's team will be different. I hope we are competitive Jan - March 2026. We'll see.

I'll be watching and rooting for them.
