I may be confused but she was appointed as the US Atty there, and confirmed by senate. Is there some reason that the US Atty in that District wouldn’t be permitted to prosecute someone after a grand jury indictment that I’m missing?
I’m not sure Jack Smith was actually constitutionally appointed - he was a special prosecutor, but not appointed by President/ confirmed by Senate.
Again, I could be confused by what her job is.

She has not been confirmed by the Senate. She filled the vacancy when Siebert resigned/was fired

Quite honestly, I’m ok with dragging this out for years, the feds will bankrupt him That’s a federal prosecutor tactic that in the event they are found not guilty they are ruined

Dukkbill what chance of success do you give the motion? I guess the DOJ isn't too worried about it since Halligan signed the Letitia James indictment on her own after being alerted to this argument.

Comey is not making sense. He told the world he welcomed the trial. "Let's get it on," he said. Why would a man not want this woman in his courtroom? Certainly she could take his mind off of his troubles.
