By the time this goes to trial the emotions of the present moment will have abated. Let's say we get a conviction but the sentence is Life Without Parole instead of capital punishment. What do you think the reaction will be? Internet grumbling but nothing substantial? Or more than that?

I think it will depend on his family.

If his wife asks to spare his life, only the most insane and rabid will have a problem with it.

Anyone have a clue what the guy at the FBI pres conference was talking about in reference for affidavits for the death penalty?

It'll probably be decades before the dude gets it- but I don't think Utah is screwing around. He's getting the DP.

Depends...

If the shooter is trans, this could result in a definitive legal finding that trans is a mental illness of such a degree that it removes criminal culpability.

This would be a sea change.

It took six years to execute Tim McVeigh.

Might as well be life without Parole.

The average time a criminal sits on death row in Utah is 34 years.

Look at Brian Kohberger. He has the rest of his days in prison, but prison already is an absolute hell for him.

Whoever sheds man’s blood,
By man his blood shall be shed;
For in the image of God
He made man.
-Gen. 9:6

I’d say if he doesn’t get the death penalty, then justice has not been done.

Life in prison is much worse than death. Hopefully it's a state prison, though. You are more likely to get butt raped in the state pen because you are in there with the lowest of the low humanity has to offer.

The death penalty could be used as leverage against an admission of guilt. Admit to it get life!

I imagine a state prison in Utah would not be the best place for the guy who killed Charlie Kirk.

Based on demographics, you're going to run into a dominant white supremacist prison population and I doubt they vote DEM

I think that's almost impossible.

I'm not sure what the Utah statutes even say about this. Dude wouldn't even be eligible for the death penalty under Texas law.

That's something I had not thought of

Most murder statutes that get you to the DP have some sort of political class targeting/assassination class of murder. The questions would be if Utah has that and if CK was considered that class of person.
