The Elk Mountain ranch owner at the center of Wyoming’s closely watched corner crossing case is preparing an appeal to the U.S. Supreme Court, new filings show.
Lawyers for Fred Eshelman asked the nation’s highest court Wednesday for a 30-day extension to file a petition seeking Supreme Court review of the case. At stake, they wrote, is “one of the broadest abrogations of private property rights in American history.”
Eshelman, through his company Iron Bar Holdings, sued four hunters in 2022, alleging they trespassed on his Elk Mountain Ranch when they passed through the airspace of his property while traveling to hunt on public land. The hunters were corner crossing — stepping from one piece of public land to another where those two parcels meet at a common corner with two private parcels, all arranged in a checkerboard pattern of ownership. They did not step on private land.

Eshelman, a wealthy North Carolina pharmaceutical executive, lost his federal suit in 2023, but appealed the matter to the U.S. 10th Circuit in Denver. A three-judge panel sided with the hunters in March. Iron Bar was given until June 16 to appeal.
Now, Iron Bar wants an additional 30 days to file a petition seeking U.S. Supreme Court review of the case.

Just here to say this landowner is a slimy cocksucker.

Is this the one where he was suing for loss of land value because now anyone can hunt on the public land and he no longer has exclusive use of public land?

Can you not drive around to the other side of the top Box Public or is it land locked by private ?
If not the private owners should shut the frick up

there are hundreds of thousands of acres in that checkerboard pattern out west. No, you can't just drive there.

its land locked and the same owner might own all the private squares in an area basically giving them double the land while only paying half the property taxes, etc. since no one else can access it.

Ranch owner runs a hunting outfit. They hunt on their land and guide on the public land. They don’t want people who aren’t paying them to have easy access to hunting. The government should have built in an easement for access to public land. 6 ft square on each corner. What are if they found some valuable commodity on the public land? I bet the government would find a way to get on that property to sell those leases.

Agree, there are bunch of them out there when it comes to this issue. I saw where the advertisement for when the property was for sale prior to this guy buying it flat out said in the listing, "With the purchase of this land comes exclusive rights to how ever many 1000's of acres of BLM land that was land locked and not accessible to the public. I wouldn't be surprised if the slime ball owner hasn't gone after the realtor and the attorneys involved in the sale of the property, he may actually have a case against them, he might be waiting to see how everything ultimately ends.

I’m all for private property rights and the uninhibited use of it but I wish there was a way to force the MFer to provide road access to the public property in this instance. I’m talking about big nice easement and all of the infrastructure needed to build a MFing highway into the public property.

Makes me want to go there right now just to cross over.

This is what it looks like. The argument the landowners were making is that when crossing corner to corner on public you're walking over their airspace even if you don't set foot on their land.
BHA has been discussing funding surveys to clearly mark where the corners are.

Supreme court will not hear the case.

What are the damages?
If trespassing charges aren't warranted there should be no issue. Waste of the courts' time.

The Public Land Survey System is used in about 30 states, including Louisiana. While people may not like the facts of this particular case, it could have a big impact on private land ownership in other situations.

There are tons of public land parcels landlocked by private holdings. These large landowners, in effect, want to double and triple their acreage by restricting the access of the taxpaying citizens to public land.

He’s claiming that his property value was based on holding exclusive access and that it was sold to him as such. He may be trying to get some money out of the seller who misrepresented it, and taking it as far as it’ll go in the court to decide the issue is the only way to go about it, but even if that’s his only intention he’s putting 4 guys at risk of jail time just to make a point, so he can get fricked either way.

By the looks of that they were just asking for trouble the way it's set up.
Heck, even the rednecks in North La fight over landlines, pipelines, roads , box stands on fence lines constantly.
Everyone has gotten so greedy and petty it ruins hunting
