It seems Mamoud khalil will likely win his immigration court hearing.

NEW YORK (AP) — Facing a deadline from an immigration judge to turn over evidence for its attempted deportation of Columbia University activist Mahmoud Khalil, the federal government has instead submitted a brief memo, signed by Secretary of State Marco Rubio, citing the Trump administration’s authority to expel noncitizens whose presence in the country damages U.S. foreign policy interests.
The two-page memo, which was obtained by The Associated Press, does not allege any criminal conduct by Khalil, a legal permanent U.S. resident
Rather, Rubio wrote Khalil could be expelled for his beliefs.
He said that while Khalil’s activities were “otherwise lawful,” letting him remain in the country would undermine “U.S. policy to combat anti-Semitism around the world and in the United States, in addition to efforts to protect Jewish students from harassment and violence in the United States.”
At the time of Khalil’s arrest, a Department of Homeland Security spokesperson accused Khalil of leading activities “aligned to Hamas,” referring to the militant group that attacked Israel on Oct. 7, 2023.
But the government has not produced any evidence linking Khalil to Hamas, and made no reference to the group in their most recent filing.

nah. Executive branch has authority to deport a non-citizen for any reason they want w/out due process. Just another judge going to get overruled.

No, I don't think so. I'm no lawyer (where's floslo?) but what I've read is that the immigration judge is typically the final word in this sort of thing.

Well I just read there's an appeal process. Ultimately I think the attorney general can overrule the immigration judge.

Feels like this is a test case. If victorious the Administration can basically remove every noncitizen that protested with relatove ease.

Maybe so I guess. If not, then they really didn't think this through at all. Not only can the Government not link him to Hamas. They can't even show where he's voiced any support to them at all.

They don't have to alledge criminal conduct. His conduct and rhetoric are antithetical to the US by voicing support and enticing civil disruption for a Terrorist Organization . That's all this guy needs to be deported. Green Cards and Student Visa's aren't a Constitutional Right.

Yeah, that is what i was thinking. If this article is correct (big if) then they seem to purposefully be trying to narrow this to a mere belief. Probably more to it, but if government wins on deportation for expression and/or mere belief then a lot of lawful residents are in jeopardy.

Well Friday we'll know if the immigration judge agrees. And to the emboldened part. The Government can't provide any evidence of that at all. At least according to the article they can't.

Acceding the Judge's request would risk implying he had the authority to issue the order in the first place, thus setting precedent. Precedent is never something one branch voluntarily cedes to another. The Judge already has jurisdictional issues.

Well if there is more to it, the Government hasn't or can't provide it.
