Can employer legally take back the money from an over payment? Is there a statute of limitations or can they go back years and years ?

Yes. Happens more often than you think.

If the employee touches base, they are free to keep it, kinda like tag at recess

Yes. My workplace took money out of our checks for a bunch of pay periods because they messed up

go back years and years...how much money are we talking about?

If they pay via direct deposit, you signed an agreement that allows them to debit and credit your account

Daughters employer. Not much money at all. Like $2000 but they are going back almost 12 years
Seems petty to me.

I had an employer pay me two paychecks over and they wanted me to pay back the gross. I sent them a check for the amount of both paychecks that was deposited in my account and told them to sue me for the rest. I never heard from them again.

What's the details here I'm just curious? They overpaid her a bonus of $2000 12 years ago or they overpaid her $2 a paycheck for 12 years?

If she’s been with the company for 12 years that’s about as petty as it gets.

My wife changed bank accounts and the general double paid her for almost a contract. One problem... She never looks at either account.
Got called in, asked for the money back, she didn't know what they were referring to and said she wasn't paying anything back until she reviewed it. They fired her immediately.
After reviewing it, called and gave a card # to cover it. They stood by firing her for "dishonesty".
We're friends with the doc who technically oversaw all of it.
As I told him: I'm sorry, but trust me, if my wife knew there was 35k sitting in her checking... She'd have spent it

2000÷12÷12= less than $14/mo. I can't imagine recovering the $2000 will be worth the time and expense.

Not positive. Something about going from 24 pay periods a year to 26. Something evidently was messed up in the process

If you still work for them absolutely. I’ve seen it done where I worked at
