Special counsel rejects dismissal of Hunter Biden case

BREAKING: Special Counsel *REJECTS* Dismissal of Hunter Biden Case After Joe Biden's 'Pardon'
In a stunning legal motion, DOJ prosecutors are opposing Hunter Biden’s request to dismiss his indictment, rejecting the notion that a presidential pardon erases the charges against him.
"The defendant pled guilty to all the charges in the indictment on September 5, 2024," Special Counsel David Weiss's filing stated. "According to the declaration filed on his behalf, the defendant again acknowledged his guilt in accepting the act of clemency."
Prosecutors emphasized that Hunter Biden had not formally docketed the pardon, stating:
"If media reports are accurate, the Government does not challenge that the defendant has been the recipient of an act of mercy. But that does not mean the grand jury’s decision to charge him, based on a finding of probable cause, should be wiped away as if it never occurred."
The filing also pushed back on Hunter Biden’s claims of improper motives behind the charges, declaring:
"It also does not mean that his charges should be wiped away because the defendant falsely claimed that the charges were the result of some improper motive. No court has agreed with the defendant on these baseless claims, and his request to dismiss the indictment finds no support in the law or the practice of this district."
The Special Counsel’s firm rejection underscores that the charges—spanning tax crimes and gun violations—are not erased by clemency. Prosecutors concluded unequivocally:
"For the foregoing reasons, the defendant’s motion to dismiss the indictment should be denied."
Hunter Biden’s legal battles are not over yet, as prosecutors dispute the implications of his father’s constitutionally dubious pardon.

Ok, so some of the legal gurus please pitch in, here. My knowledge on pardons isn't in my realm.
But if I'm reading this correctly, it sounds to me like the special council is making a fight to keep this on Hunter's legal record. Rather than to have the charges against him dismissed.
Is there really any legal ramifications to this? Other than for sending a message or grandstanding?
Under the pardon, wouldn't he have his gun rights restored, under the terms Biden set?

On a side note, the gun charges were a violation of Hunter's Second Amendment protections, and never should have been applied in the first place. Of all the bullshite Hunter has gotten away with the one thing they got him for was actually a conviction that I staunchly oppose.
Now, go back to Hunter being pardoned preemptively for anything dating back to January of 2014 (Burisma, anyone), and that becomes some blatant bullshite.

i think someone needs to legally challenge the idea of pardoning someone for crimes they have not even been charged with yet over a broad span of time

I also wondered if maybe it was a shot across the bow to remind him who is in charge or maybe even to pressure him into the 25th/Kamala first female president thing.
The one thing you can always know is that it isn't actually being tough on the Big Guy.
