House doesn't figure into any confirmations except VP.
Love Thomas and Alito, but hoping they both resign within the first two years if we get a Trump win and take the Senate. If we can lock those two seats down with young conservatives, that would be a HUGE win.

One would think that Thomas and Alito have to retire. I would love for Roberts to retire too, but I doubt that happens.
I don't see any of the dem appointees retiring (Sotomayor being the oldest at 70 currently) unless they have some serious health or personal issues pop up.

I agree that Thomas and Alito should retire and we replace them.
Then, we should introduce the same legislation that the Dems want, to increase the #. Even if it goes nowhere, just watching them contort themselves into pretzels arguing against the SAME bill they wanted passed, would be worth the gold in comedy itself.

Trump hand-waved judges that the Federalist Society vetted and recommended. In his second term he might take those decisions for himself. We might see a very different sort of Justice.

The Judiciary Act of 1869 set the number at 9 and although there have been proposals to change it (FDR wanted to be able to appoint one justice for every sitting justice age 70+, Congress wouldn't act).
The Constitution says "The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish," placing the creation of federal courts and number of justices on each court squarely on Congress.
