Show them to the jurors under controlled circumstances. That isn’t terribly difficult. But they should also monitor the jurors to see if they have any improper contacts with outside agents. Advise the jurors that all of this is going on, and get on with it.

Gee? I wonder why they didn’t think of just not handing the documents out like circus flyers in the hall of the courthouse??

The problem here, genius, is the jurors do not have authority to view the documents. They are either secrets that would compromise national security… or they aren’t. The matter in which you disclose them isn’t the issue. It’s WHO you disclose them to.

So basically change the jury selection process?

Prosecutors only get to disqualify a certain number of individuals, just like the defense. You're saying that the prosecution should be able to nitpick as many as they want and not the defense.

So they can't be like democratic politicians and operatives and plan releases of senstitive material with the media?

What’s the point? A jury of laypersons should decide whether something should be classified? Their opinion is irrelevant. Once a document is officially classified, the law regulating same is applicable.

I thought classified material should be kept and guarded to the most stringent measures.

You're using common sense but still being down voted. This seems to be exactly what the judge is saying. It appears that the government prosecutor doesn't want this, which means the documents aren't nearly as bad as they want us to think they are. Jack is just being your typical scummy lawyer who knows he has no case.

Let them see the files marked "SECRET" chances are that it was never that secret to begin with.

Now the TS/SCI stuff....give them all TS/SCI clearances in a limited capacity and allow them to view the files with the assurance that if the info is leaked that they will be the first ones that the FBI will pick up.
