I'm not sure how the NIL deals are structured but

If you're getting $1.5 million, or even $100k,
you shouldn't be able to opt out a bowl game. That should void your NIL or the very least make you pay back X amount. NIL's should be paid after the bowl game is done. Don't give them everything up front. Make them work for it.
Also, the portal should not start until after the championship game. Having it open December 4th. Is destroying these games. Even though I'm not a fan of the meaningless bowl games.

NILs should be structured to pay those who play, not those who haven't played.
I actually believe 99% of NIL deals are made with performance incentives.

NIL deals technically have to be structured so they aren't tied to you playing for a certain team. So a clause that you have to play a bowl game would need to be extremely broad.

It seems people confuse NIL for a 1099 type contract.

I don’t disagree, but this would require a level of oversight that the NCAA has refused to do. That’s the problem.

All you'd be doing is pushing the money to back channels again.

Was there ever a reason given for the December 4th date? Seems like they just threw a dart at a calendar and said that’ll work.

They’re not. That’s the point.
The NCAA and universities can’t control how adults make money off their name, image, and likeness. Recruiting is now tied to NIL so players can demand whatever they want. Someone will pay it without strings attached.

NIL isn't between the player and the school boss.
But yeah, if I was a business, I'd have a bowl game clause in there.

All the sponsors need to do is put a clause in and hold back money based on playing in the bowl game. Don’t play, you don’t get the “bowl clause money” Not difficult at all.

Seems like NIL should do like NFL did a while back. Rookies/frosh get a set amount (minimum or incentive based) and the proven players get the actual money. The biggest flaw with this is the constant portal threats for more money on vets. But it kind of this that now.

Most if not all these kids that are opting out are getting ready to be drafted to make more than their NIL deals. The only way to restructure is if you prorate or have a clause that stipulates payments to be deferred until all games are played. Problems is you will have kids still opt out if it's prorated and the for the other, kids will choose a school that won't have that certain clause. The deferred payment clause would have to be universal, but then you'll probably run into litigation from students claiming they are jeopardizing future earnings are something like that

But I get your point. NIL payments are structured the same way bags of cash of been handed out for years. Kids just have a ton of flexibility to move around now and leverage new deals.
You could incentivize an athlete to stay out by obligating them to appear in a commercial or photo shoot at a certain location for multiple future dates in order to earn the full contract value, or any other public appearances, but that’s kind of it.
