I'm confused as how people are making Oher out to be the bad guy here?

Pretty straightforward - what they know about him is from the inaccurate movie. Throw in a little racial tension angle like the first page and people will jump to defend Sandra Bullock

That said, he should be able to profit off his story being used for the movie.

He really should. The Tuohy's went from being kinda wealthy from local franchises to being worth over $50M and building this ugly mansion in a 24/7 guarded and gated community. They made over $9M off the movie if you just look at 2.5% of $390M

Please explain why a movie about him should owe him anything? Was he a creative consultant? Did he have a royalties contract?

Name, image, and likeness. You don't have the right to profit off of someone else's without their consent. Pretty basic stuff.

A public figure... With details obtained from public records (news, interviews etc) and a " based on a true story" designation can go a long long way towards but needing to pay out. Oher already said most of the movie was made up..so it sounds like a lot of artistic license was taken with a public figure with some exact details (ie game stats) taken from the news

What are the rules on adoption in that situation? Would his absentee momma had to have signed off on it?

if the movie bombed and the studios lost millions would Oher volunteer to donate some of his money back to the studio?

These things are negotiated well ahead of time.

Being an adopted child or not does give him any specific right to the Touhy estate, so I don’t see a reason he’s be motivated by that.

Does Mississippi not give the children something by default? Most states do and require that if you want to omit a child you have to expressly say so in the will.

Anyway, these are all first world rich people problems. Most of the time when someone dies in my family it costs me money.

Not really though. Oher never made a movie about not getting kicked out of basketball games or not assaulting Uber drivers. Tuohy family did

There's always more to the story though and it'll come out

Which is mind-boggling. I’m pretty sure I could live the rest of my life comfortably if someone just gave me a year or two of the average NFL salary.

Happens a lot with youth and money. They don't understand the long game. You remember Spencer and Heidi from The Hills? They spent their money like it was never going to stop. Publicly stated they thought the series was going to run for years. Youth is truly wasted on the young.

From the article:

quote:

The Blind Side, a Michael Lewis book that became he basis for an Oscar-winning film, grossed $309million. Oher alleges in the suit, the conservatorship enabled the Tuohy family to strike a deal wherein they - inclusive of their two children - would receive royalties from the heartwarming movie, specifically $225,000 each in addition to 2.5% of the 'defined net proceeds.'

According to my interpretation of the article, it was 2.5% of the NET proceeds. I am not a lawyer or CPA but my assumption is that net figure is after the cost to produce, distribute, promote, and the money paid to the actors. Let's say the net was $100M then they made $2.5M plus $225,000 for their kids and themselves ($225K x 4 = $900K).

I think he should get something but he made a lot of money because of them as well. I assume they paid the private high school he attended? In the movie, he had a private tutor and she had an apartment so if that were true, that costs them some $$.

Was is it a crappy way to handle it? Sure

Does he deserve some of the movie money? Sure

In the grand scheme of things (and assuming my "net" definition and figure is close to correct), I just don't think like we are talking about a lot of $$.

“ In the past, the Tuohys have denied making much money from the movie, saying they received a flat fee for the story and did not reap any of the movie's profits. And what they did earn, they added, was shared with Oher.

"We divided it five ways," the Tuohys wrote in their 2010 book, "In a Heartbeat: Sharing the Power of Cheerful Giving."
