I actually laughed out load reading this. Thanks

In the article is a link to the abstract where the authors say this:
He is saying state officials have the authority to enforce this part of the Constitution. Theoretically, if he is right, a Secretary of State in a state like Georgia could just leave Trump off the ballot. (do personal insults matter I have been asked? )
quote:
Section Three of the Fourteenth Amendment forbids holding office by former office holders who then participate in insurrection or rebellion. Because of a range of misperceptions and mistaken assumptions, Section Three’s full legal consequences have not been appreciated or enforced. This article corrects those mistakes by setting forth the full sweep and force of Section Three.
First, Section Three remains an enforceable part of the Constitution, not limited to the Civil War, and not effectively repealed by nineteenth century amnesty legislation. Second, Section Three is self-executing, operating as an immediate disqualification from office, without the need for additional action by Congress. It can and should be enforced by every official, state or federal, who judges qualifications. Third, to the extent of any conflict with prior constitutional rules, Section Three repeals, supersedes, or simply satisfies them. This includes the rules against bills of attainder or ex post facto laws, the Due Process Clause, and even the free speech principles of the First Amendment. Fourth, Section Three covers a broad range of conduct against the authority of the constitutional order, including many instances of indirect participation or support as “aid or comfort.” It covers a broad range of former offices, including the Presidency. And in particular, it disqualifies former President Donald Trump, and potentially many others, because of their participation in the attempted overthrow of the 2020 presidential election.

There are just so many "anti Trump" articles that people should be aware of.
I wonder why that is??

The MSM are bought and paid for. You knew this before you typed it. Being a smart arse does not change the fact that you are a dumb arse.

Even you are not dumb enough to believe that someone can be determined to have committed "insurrection" without even being charged, much less convicted, of insurrection.
Everything in that article is law professors jerking each other off in fantasyland.

Yeah it’s a glaring Constitutional due process issue.

There were no court rulings that determined the men of the Confederate Army were part of an insurrection but they were certainly treated as insurrectionist and this part of the Constitution was created for that purpose.

And that would be relevant to Trump how exactly?

100%. Pelosi should be neck swinging from the capital balcony. McConnel should have to watch and know that when she is cut down he is next.

The Cult of 45 is lashing out because they are desperate.
Trial date is going to be January 2. Right around Iowa. Trump will be behind bars with the J6ers who he failed to pardon.
I hate that it had to come to this, but it is the only chance to get the democrats out. Trump cannot win a general election. 2022 proved this.

Yeah, it's a riddle, wrapped in a mystery, inside and enigma, how there are so many anti Trump articles from the democrat propaganda media, and generationally democrat controlled academia with their marxist/communist journalism schools. Just can't figure that one out.

The clause was created to deal with the insurrection of the Civil War and still exists today.
What these lawyers are saying is one can be barred from holding office if some official decides that person was part of insurrection.
Raffensperger, for example, could simply say based on his experiences with Trump surrounding the 2020 election he has deemed him unworthy under this clause of appearing on the Georgia 2024 ballot.
quote:
No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.

“It is unquestionably fair to say that Trump ‘engaged in’ the Jan. 6 insurrection through both his actions and his inaction,” the article said.
CNN, the DNC and the FBI Stasi told them so.

Explain how Trump can get re-elected.
Not one Trump supporter has been able to so far. If he is so popular, why did all of his hand-picked candidates lose in 2022?
